BACKGROUND <br /> On March 9, 2016, the Planning Commission recommended the approval of PUD-115, a <br /> Planned Unit Development (PUD) application by Valley Capital Realty, to retain the <br /> existing single-family home and construct two new single-family homes and related <br /> improvements on separate lots located at 11249 Dublin Canyon Road. <br /> On May 3, 2016, the City Council adopted Ordinance No. 2141 approving PUD-115. <br /> On May 19, 2016, the Staff Review Board approved an application by Valley Capital <br /> Realty for Vesting Tentative Parcel Map 10538 to subdivide the subject property into <br /> three lots: one lot for the existing home and one lot for each of the two new single-family <br /> homes. <br /> In June 2017, Valley Capital Realty formed a partnership as AH Development Group, <br /> LLC to construct the subdivision improvements and to obtain improvement security, <br /> which they provided in the form of performance and labor and materials bonds in <br /> amounts of$361,910 each. <br /> AH Development Group, LLC has completed all the private and public improvements <br /> except for a private bioswale on Lot 3. Staff inspected the work and determined that all <br /> improvements are complete, except the Lot 3 bioswale, and that the public <br /> improvements are ready for acceptance. AH Development Group, LLC has requested <br /> release of their current surety bonds (performance bond, labor and material bond) in <br /> exchange for new surety bonds (performance bond, labor and material bond) in the <br /> amount of $36,191 to ensure the construction of the Lot 3 bioswale. <br /> DISCUSSION <br /> Construction of Subdivision Improvements <br /> The subdivision agreement provides for the construction of public utilities within the <br /> private street (Young Court) and Dublin Canyon Road to serve the three lots. <br /> Public Improvements <br /> The public subdivision improvements serving the three lots that will be operated and <br /> maintained by the City include: <br /> • A public sanitary sewer main, public water main, and one public fire hydrant <br /> located within dedicated public easements and within the private street; and <br /> • A public sanitary sewer main and public water main on Dublin Canyon Road; and <br /> • Curb, gutter, and sidewalk within the public right-of-way along the project's <br /> Dublin Canyon Road frontage. <br /> Private Improvements <br /> The private subdivision improvements serving the three lots that will be operated and <br /> maintained by the three lot owners as provided for in the Declaration of Easements and <br /> Maintenance Agreement, which was recorded on July 13, 2017, include: <br /> Page 2 of 3 <br />
