BACKGROUND <br /> The City of Livermore is the owner of real property located at 3801 Doolan Road. In <br /> 1994, the cities of Livermore and Pleasanton entered into a joint intergovernmental <br /> agreement for the purpose of owning and operating a radio tower at the Doolan Road <br /> site principally for transmitting the 800 MHz radio system, which served the Cities until <br /> 2012. In 2012, the Cities both converted their radio services to the East Bay Regional <br /> Radio Communications Authority. EBRCSA has used the tower since that time as one <br /> of its main transmission points. In accordance with the agreement, the tower may be <br /> made available for third-party usage subject to approval by each of the Cities. Since the <br /> late 1990's the two Cities have approved lease agreements with Zone 7, New Cingular <br /> and Wheels. The Lease with New Cingular was approved in 2014 and was amended in <br /> 2016 to allow the mounting of additional equipment on the tower. <br /> DISCUSSION <br /> New Cingular would like to amend the lease to allow for additional equipment to be <br /> mounted on the tower. The existing tower has twelve (12) panel antennas, twelve (12) <br /> RRUs mounted behind the antennas, and two (2) DC surge protectors mounted behind <br /> the antennas. Modifications include the addition of three (3) RRUs mounted behind the <br /> antennas and one (1) DC surge protector mounted behind the antennas for a total of <br /> fifteen (15) RRUs mounted behind the antennas and three (3) DC surge protectors <br /> mounted behind the antennas on the tower. Due to the modifications sought by lessee, <br /> the lease requires the Base Rent paid by lessee to be adjusted commensurate with the <br /> additional equipment and/or antenna to be installed. <br /> The New Cingular lease, which currently pays $5091 per month, would be adjusted <br /> upward by $700 per month) to $5791 per month ($200 per month for each new RRU, <br /> and $100 per month for the new surge protector). <br /> The proposed revisions to the equipment on the tower have been reviewed by City <br /> staffs and have been found to be consistent with relevant requirements. <br /> The proposal to amend the Lease would also provide New Cingular the option to extend <br /> the term of the Lease for five years.
