Market: San Francisco/Sacramento <br /> Cell Site Number: CCL00413 <br /> Cell Site Name: Livermore (CA) <br /> Fixed Asset Number: 10087959 <br /> SECOND AMENDMENT <br /> TO LEASE FOR INSTALLATION OF TELECOMMUNICATIONS EQUIPMENT <br /> This Second Amendment to January 15, 2014 Lease for Installation of <br /> Telecommunications Equipment ("Second Amendment"), is entered into on this <br /> 1 1day of F 1, 2019 ("Effective Date"), by and between the City of <br /> Livermore, a municipal corporation ("Livermore"), the City of Pleasanton, a municipal <br /> corporation ("Pleasanton"), and New Cingular Wireless PCS, LLC, a Delaware limited <br /> liability company ("Lessee"). <br /> Recitals <br /> A. Livermore and Pleasanton (collectively, the "Cities") are co-owners of a <br /> communications tower located at 3801 Doolan Road in the City of Livermore ("Tower"). <br /> B. The Cities and Lessee, entered into a Lease for Installation of <br /> Telecommunications Equipment dated January 15, 2014, as modified by that certain <br /> First Amendment to Lease for Installation of Telecommunications Equipment dated <br /> November 21, 2016 (collectively, the "Lease"). Pursuant to the Lease, Lessee installed <br /> Equipment and/or Antenna, as those terms are defined in the Lease on the Tower. <br /> C. Lessee desires to modify the Equipment and/or Antenna located on the <br /> Tower, and the Cities are willing to amend the Lease to allow Lessee to make the <br /> modifications subject to Lessee obtaining all necessary permits and approvals for that <br /> work from necessary governmental entities, including the Cities. The existing Tower has <br /> twelve (12) panel antennas, twelve (12) RRUs mounted behind the antennas, and two <br /> (2) DC surge protectors mounted behind the antennas. Modifications include the <br /> addition of three (3) RRUs mounted behind the antennas and one (1) DC surge <br /> protector mounted behind the antennas for a total of fifteen (15) RRUs mounted behind <br /> the antennas and three (3) DC surge protectors mounted behind the antennas on the <br /> Tower. Due to the modifications sought by Lessee, the Lease requires the Base Rent <br /> paid by Lessee to be adjusted commensurate with the additional Equipment and/or <br /> Antenna to be installed. <br /> D. Lessor and Lessee desire to amend the Lease to extend the Term of the <br /> Lease; <br /> Agreement <br /> NOW THEREFORE, in consideration of the foregoing and for other good and <br /> valuable consideration, the receipt and sufficiency of which are hereby acknowledged, <br /> the Cities and Lessee agree as follows: <br /> Second Amendment to January 15,2014 Lease <br /> Page 1 of 4 <br />
