12. The outdoor playground shall only be used by the childcare/preschool. The playground <br /> shall not be used when childcare/preschool is not open for business.The outdoor <br /> playground shall generally be occupied by a maximum of 24 children at any one time <br /> and for a maximum of 2.5 hours per day Monday through Friday during normal <br /> operating hours. Limited exceptions to the occupancy are allowed to accommodate <br /> activities such as a school picture day. <br /> 13. The proposed tubular steel fence around the outdoor playground shall be modified. The <br /> fence at the playground shall include an 8-foot tall, sound-attenuating double-panel solid <br /> wood fence on the north side, and shall have a six foot tall fence on the other sides. <br /> These revisions, including the style of the 6-foot tall fence on the other sides, shall be <br /> reflected on the plans submitted for the issuance of a building permit, and is subject to <br /> review and approval by the Director of Community Development prior to <br /> commencement of operation of the childcare/preschool. <br /> 14. Amplified sound (including but not limited to music and voice) taking place in the <br /> outdoor terrace area is allowed twice a year for any two of the 15 outdoor <br /> activiities/events and shall begin no earlier than 10 a.m. and end no later than 8 p.m. If <br /> amplification is used, speakers shall be directed away from adjoining residential uses <br /> immediately to the north, and sound levels shall conform to the Chapter 9.04 (Noise <br /> Regulations) of the Pleasanont Municipal Code. Not less than 12 months after <br /> operations of the Chabad under this Use Permit have commenced, Chabad of the Tri- <br /> Valley may submit a request to modify the above-stated limitations, which may be <br /> approved by the Community Development Director, approved with modifications, or <br /> denied. Such request shall be made in writing and include details of the nature of any <br /> proposed additional amplification, frequency, and hours during which amplification <br /> would be be used. <br /> 15. All exterior doors and windows on the north side of the existing buildng shall remain <br /> closed during the facility's daycare's operating hours. <br /> 16. The kitchen on the premises may only be used for the Chabad's functions, as stated in <br /> the narrative dated "Received January 8, 2018," on file with the Planning Division. The <br /> kitchen at the existing building shall not be rented for use by another user such as a <br /> catering company. <br /> 17. Chabad of the Tri-Valley shall submit a full-sized scalable floor plan, prepared by a <br /> licensed professional, to the Building and Safety Division as part of the building permit <br /> plan check review and permitting process. Said plan shall provide all information <br /> determined necessary by the Building and Safety Division for review of the building <br /> permit including, but not limited to the use of each room, dimensions of rooms and <br /> hallways, proposed partition details, window sizes and types, etc. Said plans shall be <br /> subject to review and approval by the Director of Community Development and Chief <br /> Building Official prior to issuance of a building permit. <br /> P16-0288 and P16-188, 3370 Hopyard Road City <br /> Council <br /> Page 3 of 10 <br />
