the design and dimensions of the patio allow for such occupancy. The request may be <br /> approved by the Community Development Director, approved with modifications, or <br /> denied. <br /> 6. Up to 250 persons may be allowed on the premises at one time, with use of outdoor <br /> areas subject to the limitations described in Conditions of Approval No. 4 and 5. The <br /> 250 person maximum occupancy on the premises may be reduced based on Building <br /> and Fire Code occupancy limitations, at the determination of the Fire Marshal and <br /> Building Official. <br /> 7. Prior to issuance of Certificate of Occupancy, Chabad of the Tri-Valley shall submit, for <br /> review and approval of the Community Development Director, a parking plan that <br /> describes how parking, sufficient to accommodate up to 250 persons, will be provided <br /> and managed. Such parking plan shall not result in parking impacts to adjacent <br /> neighborhoods and may, with approval of the Director of Communit Development <br /> Department, include use of public parking at the Ken Mercer Sports Park, except that <br /> the City may limit the use of this parking when it would conflict with scheduled <br /> community event(s). <br /> 8. Except for the playground, outdoor terrace area, and second patio area adjacent to <br /> Hopyard Road, no outdoor activities or events of any size shall take place elsewhere on <br /> the project site. Maintenance of the site including landscaping is not considered an <br /> outdoor activity/event. <br /> 9. Up to three storage sheds, up to 120 square feet each and up to 10 feet in height, may <br /> be located within the area of the site to the north of the existing Chabad building. Such <br /> sheds shall be located a minimum of 10 feet from the north property line. <br /> 10. All outdoor activities, whether a scheduled event/activity or other activity, and regardless <br /> of size, shall start no earlier than 7.a.m., and conclude no later than 10 p.m. <br /> 11. The outdoor playground for the childcare facility/preschool shall be relocated to the west <br /> side of the existing building, immediately to the north of the proposed outdoor terrace <br /> area, as shown in the diagram included in the April 25, 2018 agenda report. The <br /> northern perimeter of the outdoor playground shall not project beyond the north wall of <br /> the existing building. Chabad of the Tri-Valley shall submit a revised site plan depicting <br /> the location and dimensions of the outdoor playground area, subject to the review and <br /> approval by the Director of Community Development prior to issuance of a building <br /> permit for tenant improvements and prior to operation of the childcare/preschool. <br /> In addition, as part of the plans submitted for issuance of building permit, Chabad of the <br /> Tri-Valley shall submit a plan showing the design, dimensions, number and locations of <br /> the play structures and surface materials of the play area for review and approval by the <br /> Director of Community Development. <br /> P16-0288 and P16-188, 3370 Hopyard Road City <br /> Council <br /> Page 2 of 10 <br />
