Exhibit A <br /> Conditions of Approval <br /> P16-0288 and P16-0883 <br /> 3370 Hopyard Road, Chabad of the Tri-Valley <br /> April 16, 2019 <br /> PROJECT SPECIFIC CONDITIONS OF APPROVAL <br /> Planning Division <br /> 1. This conditional use permit approval amends and supersedes Conditional Use Permit <br /> No. UP-77-13. <br /> 2. All activities shall comply with Chapter 9.04 of the Pleasanton Municipal Code (Noise <br /> Regulations). <br /> 3. St. Clare's Episcopal Church and the Chabad of Tri-Valley are encouraged to meet and <br /> confer on potential amendments to the existing Shared Parking Agreement between the <br /> two parties, to address provision of parking sufficient to meet the needs of both users if <br /> and when St. Clare's Episcopal Church proceeds with its Phase II expansion. <br /> 4. A maximum of 15 large annual outdoor activities/events, defined as events with 25 or <br /> more persons, and which may include any of the events identified in Exhibit D of the <br /> June 27, 2018 Planning Commission Agenda Report, are allowed to take place in the <br /> outdoor terrace area located on the southwest side of the building. Outdoor religious <br /> events that occur over several consecutive days, such as Sukkot, are considered a <br /> single event among the 15 permitted annually. <br /> Among the 15 large annual outdoor activities/events, no more than five may occur in the <br /> months of June, July, and August. All annual outdoor activities/events shall be limited to <br /> up to 120 persons on the premises, except that up to two outdoor activities/events, <br /> which are to be counted among the 15 total allowable events, may have a total of up to <br /> 250 persons, whether indoors or outdoors, on the premises at one time. <br /> 5. In addition to the outdoor patio area shown on the approved site plans, a second patio <br /> area, to be located on the southeast side of the building, along Hopyard Road and in <br /> front of the building entry may be constructed, with design subject to review and <br /> approval by the Community Development Director. This patio shall be constructed <br /> entirely on the Chabad's private property and not encroach into the public right-of-way. <br /> The Chabad of the Tri-Valley shall construct a sound-attenuating fence or wall on the <br /> north side of this patio; other fencing treatments are allowable along the other sides of <br /> the patio, subject to Community Development Director review and approval. The <br /> southeast patio shall be used for outdoor activities involving up to 35 persons and may <br /> not be used for other large outdoor events. Not less than 12 months after operations of <br /> the Chabad under this Use Permit have commenced, Chabad of the Tri-Valley may <br /> submit a request to allow this patio to be occupied by up to 50 persons, provided that <br />
