(Condition <br /> No. 3). <br /> Outdoor events were also required to be limited to the outdoor patio area only. <br /> (Condition No. 6); to have a maximum attendance of 120 people or less (Condition No. <br /> 5), and to only be permitted between 10 a.m. and 10 p.m. (Condition No. 6) <br /> Appellants' Proposed Revisions <br /> Millers: <br /> • Large outdoor events to be further restricted to no more than one event per <br /> month in June, July, and August. <br /> • Two-month advanced notice to neighbors for outdoor event. <br /> Chabad: <br /> • No limitations on use of outdoor space for religious events and activities, except: <br /> o Noise to be regulated in accordance with the City's noise ordinance. <br /> o Maximum number of people be regulated by the requirements of the <br /> Parking Ordinance. <br /> Staff Analysis/Response <br /> Staff does not recommend any revision to the August 21 Conditions as they relate to <br /> large events. The proposed maximum number and size of events is consistent with the <br /> narrative provided by the Chabad; it would also accommodate the set of religious <br /> events and activities with an outdoor component that were identified by the applicant. <br /> The analysis under item 1, above, discusses parking capacity, which supports staff's <br /> recommendation that event sizes be limited to no more than 120 people, unless <br /> additional parking can be provided on-site. No expansion of the size or frequency of <br /> outdoor events would be permitted under the Temporary Use Permit provision noted <br /> above. <br /> With respect to the Miller's proposed revisions, staff believes it appropriate to allow <br /> flexibility for the Chabad to hold more than one outdoor event in a given month <br /> (particularly given that the Jewish and Gregorian calendars are not identical); and that a <br /> two-month notification period is unnecessary given that the calendar of religious <br /> holidays is predictable through the course of the year. <br /> 3. Size and Location of Small Outdoor Gatherings (25 or Fewer People) <br /> The current conditions do not restrict the frequency or type of small outdoor <br /> events/activities, which are defined as any gathering of 25 or fewer people. However, <br /> per the August 21 Conditions, such gatherings may only take place within the outdoor <br /> patio area (Condition No. 5), and may not take place after 10 p.m. (Condition No. 6) <br /> Page 6 of 14 <br />
