Appellants' Proposed Revisions Millers and Chabad: • Both the Millers and the Chabad agreed that it would be appropriate to create a secondary patio area at the south and southeast side of the building (along Hopyard Road) to be the designated area for small gatherings. Millers: • No event, regardless of size, should start before 7 a.m. Chabad: • No limitations on hours for gatherings of 25 people or fewer. Staff Analysis/Response Staff supports the addition of a second patio area to be located along the south/ southwest side of the building, which would be used for small outdoor gatherings, rather than the larger outdoor patio. A condition of approval, reflecting this patio area, has been added in the redline draft included in Attachment 1. Staff believes it is still appropriate to retain a limitation on the evening hours of use of the second patio but does not feel it necessary to limit the early morning use of the facility as suggested by the Millers. 4. Amplification at Outdoor Events Condition No.10 of the August 21 Conditions limit use of amplification to no more than two of the 15 annual events, to begin no earlier than 10.a.m. and end no later than 8 p.m. Appellants Proposed Revisions I Millers: • Amplified voices (i.e. use of a microphone) at large events may be used for short periods, such as to direct guests, or music (such as during a bride's approach down the aisle) may be allowed at additional large events, provided that it is for a short period only. • Amplified sound (such as music played through speakers) may be allowed at small gatherings, provided that it was not audible to neighbors. Chabad: • No limitations on use of outdoor sound at any outdoor event, provided amplification is directed away from residential uses to the immediate north. Page 7 of 14
