• Parking for special events and major religious holidays, with an assumed maximum occupancy of up to 120 people, was also calculated. The analysis used assumptions that 30 percent of attendees would walk, and that 25 percent of the remaining number would carpool — resulting in a total demand of 63 parking spaces. Conditions of approval are included to avoid and address potential excess parking demand, including coordinated calendars between St. Clare's and Chabad, requiring parking monitoring, and securing off-site parking. Based on this analysis, increasing allowed maximum capacity above 120 would almost certainly require additional on-or off-site parking to be secured, if the maximum number of people were present. Capacity Based on Building Occupancy Allowable occupancy is governed by the Building Code and Fire Code, based on square footage, type of occupancy, and actual building design in terms of egress and other safety considerations. Since the application did not include detailed building plans, it is not possible to calculate allowable occupancy with precision. However, an indication can be derived based on "design occupancy" factors established in the building code, which in turn is used to determine minimum egress requirements. According to calculations provided by the Building Division, and assuming all of the spaces in the building are occupied, the maximum design occupant load' per Building Code would be 259 people. Maximum design occupancy load of the synagogue space alone would be 143 people. Staff Recommendation Based on the above, it appears that the building occupancy could allow for more than 120 people to be accommodated (and especially if outdoor spaces are considered). However, staff does not recommend increasing the maximum allowable occupancy of the facility, unless additional on-site parking could be provided. Nonetheless, staff recognizes that there may be times, such as during major religious holidays, that more than 120 people could wish to attend the facility. A condition of approval has been added that would allow the Chabad to apply for a temporary use permit, to allow a capacity of up to 250 persons for events, occurring no more than five times per year, provided that the Chabad is able to demonstrate that it would have off-site parking available for event attendees. The modified condition would not allow an increase in outdoor event size. 2. Number, Size, and Frequency Large Outdoor Events/Activities The August 21 Conditions define an "Outdoor activity or event" as any outdoor activity involving 25 or more people. The conditions establish a limit of up to 15 annual outdoor activities/events, inclusive of a specific list of religious holidays with an outdoor ' The Building Code does not specify a maximum occupant load, only a design occupant load in order to determine the minimum means of egress requirements. The posting of the occupant load is only required by code in rooms used for assembly, classroom, dining, drinking or other similar purposes when the occupant load of a room or space exceeds 50.
