Once a lead agency approves a project, the <br /> responsible agency must act within 90 days of the lead agency's approval or within 90 <br /> days of the date an application has been received and accepted as complete by the <br /> responsible agency, whichever time is longer. <br /> AB 2442 (Holden) Density Bonuses. <br /> Chapter 756, Statutes of 2016 <br /> This measure requires a local agency to grant a density bonus to a housing developer <br /> that agrees to set aside at least 10 percent of a housing development for transitional <br /> foster youth, disabled veterans, or homeless persons. The units must be subject to a <br /> recorded affordability restriction of 55 years and be provided as very low-income units. <br /> AB 2501 (Bloom) Housing. Density Bonuses. <br /> Chapter 758, Statutes of 2016 <br /> This measure makes a variety of technical and process changes to density bonus law <br /> including: <br /> • Prohibits local agencies from requiring an additional report or study that is not <br /> otherwise required by state law. This does not prohibit local agencies from <br /> requiring reasonable documentation to establish eligibility for a requested density <br /> bonus; <br /> • Requires local agencies to adopt procedures and timelines for processing a <br /> density bonus application, and to provide a list of all documents and information <br /> required with a density bonus; <br /> • Requires local agencies to notify the applicant for a density bonus whether the <br /> application is complete; <br /> • Adds authority for a local agency to deny a concession or incentive if it does not <br /> result in identifiable and actual cost reductions; <br /> • Requires the local agency to bear the burden of proof for the denial of a <br /> requested concession or incentive; and <br /> • Adds mixed use developments to the definition of "housing development". <br /> AB 2556 (Nazarian) Density Bonuses. <br /> Chapter 761, Statutes of 2016 <br /> This measure provides a process for determining the number and type of affordable <br /> housing units necessary for density bonus eligibility for projects where a proposed <br /> development is replacing affordable housing units and requires that the units be <br /> replaced in compliance with the jurisdiction's rent or price control ordinance. <br /> AB 2685 (Lopez) Housing Elements. Adoption. <br /> Chapter 271, Statutes of 2016 <br /> This measure requires planning agency staff to compile public comments regarding a <br /> proposed housing element and provide the comments to each member of the city <br /> council or board of supervisors. <br />
