• Clarifies that the total area of floorspace shall not exceed 50 percent of the <br /> proposed or existing primary dwelling living area or 1,200 square feet; <br /> • An ADU shall not be considered by a local agency, special district, or water <br /> corporation to be a new residential use for purposes of calculating connection <br /> fees or capacity charges for utilities, including water and sewer service; <br /> • Defines "tandem parking" means two or more automobiles are parked on a <br /> driveway or in any other location on a lot, lined up one behind the other; <br /> • Clarifies that an ADU may be rented separate from the primary residence, but <br /> shall not be sold or otherwise conveyed separately from the primary residence; <br /> and <br /> • Permits HCD to review and comment on the ordinances. <br /> Land Use/Planning (2017) <br /> AB 678 (Bocanegra) Housing Accountability Act. <br /> Chapter 373, Statutes of 2017 <br /> This measure makes numerous changes to the Housing Accountability Act (HAA). This <br /> measure: <br /> • Changes the evidentiary standard for a local agency to disapprove a housing <br /> development project from "substantial" evidence in the record to a <br /> "preponderance of the" evidence in the record; and <br /> • Requires, if the court determines that the local agency has failed to comply with <br /> the order or judgment compelling compliance within 60 days, the court to impose <br /> fines of $10,000 per unit on a local agency that has violated the HAA. <br /> AB 879 (Grayson) Planning and Zoning. Housing Element. <br /> Chapter 374, Statutes of 2017 <br /> This measure makes numerous changes to housing element law and requires HCD to <br /> conduct a study to determine the reasonableness of local fees charged to new <br /> developments. Regional Housing Needs. <br /> Chapter 206, Statutes of 2017 <br /> This measure makes numerous changes to the process to determine the population <br /> projections for the Regional Housing Needs Assessment (RHNA) allocation. <br /> AB 1397 (Low) Local Planning. Housing Element. Inventory of Land for <br /> Residential Development. <br /> Chapter 375, Statutes of 2017 <br /> This measure, among other things, revises the inventory of land suitable for residential <br /> development identified in a city's housing element to include vacant sites and sites that <br /> have "realistic and demonstrated potential" for redevelopment to meet a portion of the <br /> locality's housing need for a designated income level. <br /> 5 <br />
