BACKGROUND <br /> On September 11, 2013, the Planning Commission approved an application by <br /> Pleasanton Gateway, LLC for Vesting Tentative Map 8147 to subdivide the subject <br /> property into ninety-seven lots for single-family homes, one lot for the apartment <br /> complex, and nineteen lots for common areas and amenities (such as the recreation <br /> area and the public trail along the west side of the site), private streets, guest parking <br /> spaces, and utilities and storm water treatment areas. <br /> In December 2013, Civic Gateway, LLC purchased the site from Pleasanton Gateway, <br /> LLC. <br /> On July 15, 2014, Civic Gateway, LLC submitted improvement security in the form of a <br /> performance bond and a labor and materials bond each in the amount of$6,826,850 as <br /> provided for in the subdivision agreement to ensure the construction of the public and <br /> private improvements necessary to serve the subdivision. On July 18, 2014, an <br /> encroachment permit was issued and construction started soon thereafter. <br /> On December 21, 2016, Civic Gateway, LLC informed staff that all public and private <br /> improvements were completed and requested a release of the performance and labor <br /> and materials bonds. Staff inspected the work and determined that approximately 90% <br /> of the public improvements were complete and ready for acceptance. <br /> On June 6, 2017, the City Council accepted 90% of the public improvements and <br /> authorized the City Clerk to file a Notice of Completion and release the performance <br /> bond and labor and materials bond in exchange for improvement security in the amount <br /> of $125,000 for the remaining work. <br /> In July 2017, Civic Gateway, LLC submitted a performance bond and labor and <br /> materials bond in amounts of $125,000 each for the remaining work and the City Clerk <br /> released the original performance bond and labor and materials bond. <br /> DISCUSSION <br /> Construction of Subdivision Improvements <br /> The subdivision agreement provided for the construction of public streets with public <br /> utilities; and private streets with public sanitary sewer and water mains. <br /> Public Subdivision Improvements <br /> The public subdivision improvements serving the 97 single family homes include: <br /> • Public streets (labeled on Tract Map 8147 as Brookline Loop, Freeman Lane, <br /> Lexington Lane, Plymouth Avenue, and Township Circle), and the following <br /> improvements located within those streets will be operated and maintained by <br /> the City: sanitary sewer mains, storm drain systems, water mains, fire hydrants, <br /> and street lights. <br /> • The sanitary sewer mains, water mains, and fire hydrants within the following <br /> private streets and parcels are public and will be operated and maintained by the <br /> City: <br /> Page 2of4 <br />
