Prohibition of topless and bottomless <br /> public performers. <br /> <br /> A person is guilty of a misdemeanor who, while parti- <br />cipating in a live act, demonstration, or exhibition in a <br />public place, place open to the public, or place open to <br />public view: <br /> <br /> (a) exposes his or her genitals, pubic hair, buttocks, <br />natal cleft, perineum, anal region or pubic hair region~ <br /> <br /> (b) exposes any device, costume or covering which gives <br />the appearance of or simulates the genitals, pubic hair, <br />buttocks, natal cleft, perineum, anal region or pubic hair <br />region; or <br /> <br /> (c) exposes any portion of the female breast at or <br />below the areola; more specifically, any portion of either <br />breast below a straight line so drawn that both nipples <br />and all portions of both breasts which have a different <br />pigmentation than that of the main portion of the breasts <br />are below such straight line. Tassels, pasties, stars or <br />transparent material are not acceptable coverage. <br /> <br />Sec. 4-15.05. Counseling or assisting. <br /> <br /> A person is guilty of a misdemeanor who causes, permits, <br />procures, counsels or assists a person to expose or simulate <br />the exposure prohibited in Section 4-15.04 of this Code. <br /> <br />Sec. 4-15.06. Exemption for theatres. <br /> <br /> The provisions of this chapter do not apply to theatres. <br />For purpose of this section, "theatre" shall mean a building, <br />playhouse, room, hall or other place having permanently <br />affixed seats so arranged that a body of spectators can have <br />an unobstructed view of the stage, upon which theatrical or <br />vaudeville performances or similar forms of artistic expres- <br />sion are presented, and where such performances are not <br />incidental to the promoting of the sale of food, drink, or <br />other merchandise. <br /> <br />Sec. 4-15.07. Prohibition of topless and bottomless <br /> e.mployees. <br /> <br /> A person is guilty of a misdemeanor who, while employed <br />in a public place, place opened to the public, or place open <br />to public view, which place or conduct is not subject to <br />the regulations set forth in Sections 4-15.01, 4-15.04 or <br />4-15.06: <br /> <br /> (a) exposed his or her genitals, pubic hair, buttocks, <br />natal cleft, perineum, anal region or pubic hair region; <br /> <br /> (b) exposes any device, costume or covering which gives <br />the appearance of or simulates the genitals, pubic hair, <br />buttocks, natal cleft, perineum, anal region or pubic hair <br />region; or <br /> <br /> -2- <br /> <br /> <br />
