(c) exposes any portion of the female breast at or <br /> below the areola; more specifically, any portion of either <br /> breast below a straight line so drawn that both nipples <br /> and all portions of both breasts which have a different <br /> pigmen~ation than that of the main portion of the breasts <br /> are below such straight line. Tassels, pasties, stars or <br /> transparent material are not acceptable coverage. <br /> <br /> Sec. 4-15.08. Counseling or assisting. <br /> <br /> A person is guilty of a misdemeanor who causes, permits <br /> procures, counsels or assists a person to expose or simulate <br /> the exposure prohibited in Section 4-15.07 of this Code. <br /> <br /> Sec. 4-15.09. Employment or payment not necessary <br /> for offense. <br /> <br /> A person is considered an employee, for purposes of <br /> Section 4-15.07, without regard to whether or not he is <br /> entitled to compensation by the management of the establish- <br /> ment in which the activity is performed, or manages said <br /> establishment, or owner, is a tenant in common, leasee or <br /> has the right to the use of the premises under any other <br /> form of legal entitlement. <br /> <br /> Section 2. If any section, subsection, subdivision, para-- <br />graph, sentence, clause or phrase of this ordinance or any part <br />thereof is for any reason held to be unconstitutional, such <br />decision shall not affect the validity of the remaining portions <br />of this ordinance or any part thereof. The City Council hereby <br />dclares that it would have passed each section, subsection, <br />subdivision, paragraph, sentence, clause or phrase thereof, <br />irrespective of the fact that any one or more sections, sub- <br />sections, subdivisions, paragraphs, sentences, clauses or <br />phrases be declared unconstitutional. <br /> <br /> Section 3. This ordinance shall become effective thirty <br /> <br /> 30) days after the date of its final passage and adoption. <br /> <br /> Section 4.
