CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 704 <br /> <br /> AN ORDINANCE ADDING ARTICLE 15 TO TITLE IV (HEALTH, <br /> SAFETY, MORAL, AND GENERAL WELFARE) OF THE ORDINANCE <br /> CODE OF THE CITY OF PLEASANTON REGULATING CONDUCT BY <br /> WAITERS , WAITRESSES , ENTERTAINERS , OTHER PUBLIC <br /> PERFORMERS AND EMPLOYEES <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN <br />AS FOLLOWS: <br /> <br /> Section 1. Article 15 entitled "Regulation of Conduct <br /> <br />by Waiters, Waitresses, Entertainers, and Other Public Performers" <br />is hereby added to Title IV of the Ordinance Code of the City <br />of Pleasanton to read as follows: <br /> <br /> ARTICLE 15. REGULATION OF CONDUCT BY WAITERS, <br /> WAITRESSES , ENTERTAINERS , OTHER PUBLIC PERFORMERS <br /> AND EMPLOYEES <br /> <br /> Sec. 4-15.01. Prohibition of topless and bottomless <br /> waiters, waitresses and entertainers. <br /> <br /> A person is guilty of a misdemeanor who, while <br /> acting as a waiter, waitress or entertainer in an <br /> establishment which serves food or beverages, or both, <br /> including but not limited to alcoholic beverages for <br /> consumption on the premises of such establishment: <br /> <br /> (a) exposes his or her genitals~ pubic hair, buttocks, <br /> natal cleft, perineum, anal region or pubic hair region; <br /> <br /> (b) exposes any device, costume or covering which <br /> gives the appearance of or simulates the genitals, pubic <br /> hair, buttocks, natal cleft, perineum, anal region or <br /> pubic hair region; or <br /> <br /> (c) exposes any portion of the female breast at or <br /> below the areola; more specifically, any portion of either <br /> breast below a straight line so drawn that both nipples <br /> and all portions of both breasts which have a different <br /> pigmentation than that of the main portion of the breasts <br /> are below such straight line. Tassels, pasties, stars or <br /> transparent material are not acceptable coverage. <br /> <br /> Sec. 4-15.02. Counseling or assistinq. <br /> <br /> A person is guilty of a misdemeanor who causes, permits <br /> procures, counsels or assists a person to expose or simulate <br /> the exposure prohibited in Section 4-15.01 of this Code. <br /> <br /> Sec. 4-15.03. Employment or payment not necessary <br /> for offense. <br /> <br /> A person is considered a waiter, waitress or enter- <br /> tainer if he acts in that capacity without regard to 1 <br /> whether or not he is entitled to compensation by the ' <br /> <br /> <br />
