EXHIBIT A <br />CONDITIONS OF APPROVAL <br />PCUP-247, SNAP Fitness <br />6654 Koll Center Parkway, Suite 355 <br />September 9, 2009 <br />1. The approval covered by this application shall be substantially as shown on the <br />written narrative, site plans, floor plan and related material, dated "Received, <br />July 20, 2009," Exhibit B, on file with the Planning Division, except as modified <br />by the following conditions. Minor changes to the approved operation may be <br />allowed subject to the review and approval by the Director of Community <br />Development if found to be in substantial conformance to the approved exhibits. <br />2. All conditions of approval of PUD 80-2 (Bernal Plaza) shall remain in full force <br />and effect. <br />3. This Conditional Use Permit approval will lapse within one (1) year from the date <br />of approval unless the proposed facility has obtained a business license, paid all <br />applicable fees and/or prior to operations, or an extension has been applied for <br />and approved by the Planning Division. <br />4. All activities shall take place inside of the facility. The hours of operation are: <br />Monday thru Sunday, 24 hours a day, 365 days a year (including holidays) <br />5. No person under the age of 18 years shall be allowed to use the facility unless <br />accompanied by an adult. <br />6. The applicant shall work with staff on the feasibility of installing a bike rack in <br />front of the facility on Koll Center Parkway. <br />7. If any elements of the proposed use result in conflicts pertaining to parking, <br />noise, traffic, loitering, or other impacts, at the discretion of the Director of <br />Community Development, this use permit may be submitted to the Planning <br />Commission for subsequent review at a public hearing. If necessary, the <br />Planning Commission may modify or add conditions to mitigate such impacts, or <br />may void the said use permit. <br />8. The applicant shall contact the Building and Safety Division and the Fire <br />Department to determine all applicable requirements and obtain all applicable <br />fees and permits. <br />
