17. The homeowners association created for this project shall be responsible <br />for the maintenance of the soundwall and emergency vehicle access <br />(EVA) gate to be installed along the northern boundary of the City's <br />Operation Service Center. The project CC&R's shall address this <br />maintenance responsibility. The City will be responsible for the cosmetic <br />upkeep on the Operation Service Center side of the wall and any damage <br />to the wall caused directly by City personnel. <br />18. The homeowners association created for this project shall be responsible <br />for the maintenance of the improvements in Parcel D, including the gate to <br />be installed at the end of the trail connection. The project CC&R's shall <br />address this maintenance responsibility. <br />19. The applicant shall give notice to any prospective owners of the <br />maintenance responsibilities of the homeowners association. The City <br />Attorney shall approve the exact language of the notice. <br />20. The applicant shall grant an emergency access easement over the portion <br />of the private street between the project entry at Reimers Drive and the <br />emergency vehicle access (EVA) gate along the north side of the City's <br />Operations Service Center. <br />21. The applicant shall prepare all necessary documents for the City to enter <br />into an agreement/license with Zone 7 for the construction and <br />maintenance of any portion of the public trail that is located on Zone 7's <br />property. <br />22. The improvement plans shall include a detail of the gate to be installed at <br />the end of the trail connection near the northeast corner of the subdivision <br />and a landscape plan for the landscaping installed along the sides of the <br />trail connection. Said detail/plan shall be subject to the review and <br />approval by the Director of Community Development prior to issuance of <br />building or grading permits. <br />23. Details of the public trail improvements in the old Mohr Avenue right-of- <br />way shall be shown on the improvement plans, including the installation of <br />new fencing and/or modification of existing fencing in the trail corridor, <br />modification of existing landscaping in the Ironwood development, <br />installation of trail signage, and other trail -related improvements. Said <br />details shall be subject to the review and approval by the Director of <br />Community Development prior to issuance of building or grading permits. <br />24. The applicant shall work with staff to the extent feasible to lower the <br />grades of the public trail located north of the Sagewood Court lots <br />provided grading is minimized and the need for additional drainage <br />infrastructure is not required.
