10. The score pattern and color of the pervious concrete pavement shall be <br />shown on the improvement plans and shall be subject to the review and <br />approval by the Director of Community Development prior to issuance of <br />building or grading permits. <br />11. Additional catch basins may be required on the improvement plans as <br />determined by the City Engineer to mitigate the potential of the storm drain <br />grates clogging with debris. Where a sump condition exists within the <br />street, the storm drain shall be designed for a 50 -year storm event unless <br />otherwise approved by the City Engineer. <br />12. The curb and gutter of all streets within the development, including median <br />and traffic islands, shall have subdrains installed at either the back of curb <br />or lip of gutter, as determined by the City Engineer. Bioswales with less <br />than one -percent grade shall have subdrains installed at the bottom of the <br />swale. These details shall be shown on the improvement plans. Said <br />subdrains shall be connected to the storm drain system or drained by <br />other means acceptable to the City Engineer. <br />13. The V -ditch adjacent to the public trail in the old Mohr Avenue right-of-way <br />and the grading on the Legacy Partners' property shall be hydroseeded <br />after work in this area has been completed. <br />14. The applicant shall enter into a maintenance agreement with the City <br />which specifies that the homeowners association shall be responsible for <br />the maintenance of Reimers Drive between the existing roundabout at <br />Ironwood Drive and the project entry. <br />15. The project's homeowners association shall share with the existing <br />Ironwood Development the pro rata maintenance cost of the landscaping <br />on both sides of Ironwood Drive, including the median; both sides of <br />Busch Road, excluding the median; Reimers Drive, including the traffic <br />circle; and the northernmost edge of the Valley Avenue landscaping <br />installed with the Ironwood Development, including the Iron Horse Trail <br />corridor landscape not maintained by the City. Said maintenance <br />responsibilities shall start no later than after 80 percent of the homes have <br />been sold. The project CC&R's shall address this maintenance <br />responsibility. <br />16. The homeowners association created for this project shall be responsible <br />for the replacement of the base rock and pervious concrete in the event <br />the City's water main or sanitary sewer under the pervious concrete <br />requires repair. The project CC&R's shall address this maintenance <br />responsibility. <br />3 <br />
