II. Scope of Determination Made By Planning Commission <br />5. Pursuant to §§ 18.12.050 through 18.12.070 of the City's Municipal Code, <br />Sunrise submitted an application for a Zoning Certificate to confirm that its <br />submitted plans substantially conformed to the development standards set forth <br />in PUD -85-09, as required by Condition of Approval No. 1 of PUD -85-09. <br />6. At a duly noticed public hearing on June 11, 2008, the Planning Commission <br />reviewed the application for a Zoning Certificate and received comments from <br />the public. <br />7. At the June 11, 2008 hearing, the Planning Commission requested that the <br />applicant engage with neighbors of the Project Site and work on refinements to <br />the submitted plans. In particular, comments from the Planning Commission <br />focused on ensuring that: (a) the height and mass of the building do not <br />exceed the intended development standards of PUD -85-09; and (b) the <br />intensity of use of the proposed building does not exceed what was intended by <br />PUD -85-09, taking into account current regulations governing the provision of <br />care to seniors. <br />8. Sunrise has participated actively in several facilitation sessions with a facilitator, <br />the Director of Community Development, and neighborhood representatives <br />who conveyed the interests of the neighbors in areas surrounding the Project <br />Site. During the course of these sessions, Sunrise has refined the submitted <br />plans to both respond to neighborhood comments about the design and <br />functionality of the proposed facility while simultaneously bringing the plans into <br />greater conformity with the approved PUD -85-09 project in response to <br />direction by the Planning Commission. <br />9. Sunrise submitted a refined set of plans and supporting documentation, <br />Exhibit A. The sole issue before the Planning Commission is the ministerial <br />determination of whether the Project as set forth in the Refined Submittal <br />substantially conforms to the minimum design guidelines and development <br />standards of the Planned Unit Development zoning for the site (PUD -85-09). <br />III. The Refined Submittal Substantially Conforms to PUD -85-09 <br />The height and massing of the building as set forth in the Refined Submittal <br />substantially conforms to the City's planned development zoning approval for the <br />Project Site. <br />10. PUD -85-09 was described in approval documents as a two- and three-story <br />structure. In addition, the footprint of the structure was reflected on a site plan <br />indicating minimum setbacks of 16 feet from Foothill Road, 75 feet from <br />Stoneridge Drive, 17 feet from Pleasant Hill Road, and 15 feet from the Moller <br />Park.
