EXHIBIT B <br />Findings of the Planning Commission in Support of a <br />Zoning Certificate— PUD -85-09, Sunrise Senior Living <br />December 10, 2008 <br />The Planning Commission hereby adopts the following findings to affirm the <br />determination of the Zoning Administrator that the plans submitted by Sunrise Senior <br />Living ("Sunrise") for the approximately 2.5 -acre property located at 5700 Pleasant Hill <br />Road ("Project Site") substantially conform to the existing planned unit development <br />zoning ("PUD -85-09") previously adopted by the City for the Project Site. Based on the <br />findings set forth below, the Planning Commission hereby confirms the Zoning <br />Administrator's determination that the Refined Submittal substantially conforms to <br />PUD -85-09 and hereby authorizes the Zoning Administrator to issue a Zoning <br />Certificate confirming that the plans and supporting documentation, attached as <br />Exhibit A to Resolution No. PC -2008-61, ("Refined Submittal") substantially conform to <br />the existing zoning for the Project Site. <br />BACKGROUND ON PUD -85-09 <br />The City approved a Planned Unit Development zoning ordinance (PUD -85-09) <br />in 1985 that allows for development of a senior retirement facility on the Project <br />Site. <br />2. The City has previously determined in the context of a similar proposal for the <br />Project Site in 2000 by Willow Partners LLC that the existing planned <br />development zoning on the Project Site — PUD -85-09 — remains valid and that <br />no further discretionary approval is required for a senior retirement facility <br />substantially conforming to the 1985 approval to proceed (City Manager <br />Memorandum to, City Council of April 25, 2000). <br />3. The Project Site has a "Retail/Highway/Service Commercial; Business and <br />Professional Offices" land use designation under the City's General Plan. The <br />General Plan provides that all projects receiving PUD development plan <br />approval be deemed to be in compliance with the General Plan prior to <br />approval. <br />4. The City has previously determined, in the context of a similar unbuilt proposal <br />for the Project Site in 2000, a proposed senior retirement facility to be in <br />substantial conformance with the 1985 PUD approval. <br />
