C. The proposed conditional use will comply with each of the applicable provisions of the zoning ordinance. The proposed conditional use is required to comply with all applicable sections ofthe Pleasanton Municipal Code governing the subject property. Conditions of approval will ensure the compliance of the service station/convenience market with the City's zoning ordinance and its objectives. By complying with the conditions of approval, the proposed establishment would meet the criteria for receiving a conditional use permit and would, therefore, comply with the intent of the zoning ordinance. WHEREAS, the Planning Commission determined that the proposed use will be compatible with the existing commercial and residential uses surrounding the site. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Section 2. Approves Case UP-97 - 70, the application of Chevron Products Company, Inc. for conditional use permit approval to allow the construction and operation of a 24-hour self-service gasoline station and convenience store with the sale of alcoholic beverages located at 1797 Santa Rita Road, subject to the conditions shown in Exhibit "C" attached hereto and made part of this case by reference. This resolution shall become effective 15 days after its passage and adoption unless appealed prior to that time.
