PLANNING COMMISSION CITY OF PLEASANTON

ALAMEDA COUNTY, CALIFORNIA

RESOLUTION NO. PC-98-64

RESOLUTION RECOMMENDING APPROVAL OF THE APPLICATION OF
CHEVRON PRODUCTS COMPANY, AS FILED UNDER CASE UP-97-70

WHEREAS, Chevron Products Company, Inc. has applied for conditional use permit approval
to allow the construction and operation of a 24-hour self-service gasoline station
and convenience store with the sale of alcoholic beverages located at 1797 Santa
Rita Road; and

WHEREAS, zoning for the property is C-N (Neighborhood Commercial) District; and

WHEREAS, at its duly noticed public hearing of July 29, 1998, the Planning Commission,
after considering all public testimony, relevant exhibits, and recommendations of
the City staff, recommended approval of the proposed negative declaration
prepared for Case UP-97-70; and

WHEREAS, the Planning Commission made the following findings:

A. The proposed location of the conditional use is in accordance with the
objectives of the zoning ordinance and the purpose of the district in which
the site is located.

Convenience markets are allowed uses and service stations are
conditionally allowed uses in the nearby Amador Shopping Center, Valley
Plaza, and Mission Plaza centers. The proposed convenience
market/self-service station would provide commodity and service
primarily oriented towards nearby residential uses and would be operated
in a manner making it compatible with nearby office uses.

B. The proposed location of the conditional use and the conditions under
which it would be operated or maintained will not be detrimental to the
public heath, safety, or welfare, or materially injurious to the properties or
improvements in the vicinity.

The location of the proposed convenience market/service station would
provide adequate separation from the nearby residential neighborhoods.
There would be adequate parking available for the employees and
customers of the proposed service station during its operation.
