The project developer shall plant vines along the entire length of the metal trellis <br />located on the upper level of the parking deck. The project developer shall relocate the existing twelve-foot (12' 0") diameter sat- <br />ellite receiving dish, located in the approximate northwest section of the site facing <br />the Foothill Road entrance ramp, to the roof of the five- (5-) story office building. <br />If, for structural reasons, relocating the dish to this location is not feasible, the pro- <br />ject developer is required to submit with the building permit application measures <br />by which the satellite dish would be screened in its present location. <br /> <br />Traffic Mitigation Requirements: <br /> <br />16. The property owner or its successors in interest (owner) shall enter into an agree- <br />ment with the City of Pleasant on (City) to provide that: <br /> <br />a. the owner shall either not protest the establishment of an assessment district, <br />or shall affirmatively vote for the creation of the district or other mechanism <br />to pay the construction costs for the I-6801West Las Positas Boulevard free- <br />way interchange, or alternative traffic mitigation improvement(s) selected by <br />the City Council, depending on the manner of creation of the funding mecha- <br />msm; <br /> <br />b. the owner retains the right to protest that the allocation of costs among vari- <br />ous properties is inequitable under the above-mentioned funding mecha- <br />nisms; and, <br /> <br />2-98-071.
