Resolution No. PC-98-38
Page 3

Erosion control and dust suppression measures will be documented in the
final map and will be administered by the City's Building and Public
Works Departments. The property is not located in the Alquist-Priolo
Study Zone. According to the United States Department of Housing and
Urban Development Flood Hazard maps, no portion of the site is located
in a flood hazard zone.

5. Streets and buildings have been designed and located to complement the
natural terrain and landscape.

The subject property is an in-fill site adjacent to existing older and newer
residential units. The shared driveway of Parcels 2 and 3 is wide enough
to accommodate the few number of cars and trips expected from this type
of residential development. Conditions prohibiting parking in the
driveway (except the designated parking spaces) through easements and
CC&Rs, will help to ensure that the driveway is available for use at all
times by all parties. All homes would be accessible to emergency service
vehicles, which could park off-street if necessary. The applicant has
indicated on the plans the dedication and street widening improvements
necessary to construct a sidewalk along Kottinger Drive, provide a
right-turn lane from Kottinger Drive onto First Street, and create a bus
turn-out and shelter along First Street.

6. Adequate public safety measures have been incorporated into the design of
the plan.

All the necessary public safety measures have been incorporated into the
design of the plan. The buildings are being constructed to meet code
requirements.

7. The plan conforms to the purposes ofthe PUD District.

The proposed PUD rezoning and development plan conforms to the
purposes of the PUD district. One of these purposes is to insure that the
desires of the developer and the community are understood and approved
prior to commencement of construction. Another is to provide a
mechanism whereby the City can designate parcels and areas requiring
special consideration regarding the manner in which development occurs.
