review and approval of the City Attorney, Planning Director, and the East Bay <br /> Regional Park District. <br /> <br />37. Areas which are offered to be dedicated to the East Bay Regional Park District but <br /> not indicated as accepted at this time shall be added to Lots 1, 6, and 7 as shown in <br /> Exhibit "D". These areas shall be shown on the Final Map as an open offer of <br /> dedication to the East Bay Regional Park District. A conservation/scenic easement <br /> in favor of the City shall be recorded over these areas. This easement shall <br /> indicate that no future development is permitted within these areas except in <br /> conformance with the East Bay Regional Park District's master plan and subject to <br /> review and approval of the City. The text of this easement shall be subject to the <br /> review and approval of the City Attorney, Planning Director, and the East Bay <br /> Regional Park District. <br /> <br />38. A conservation/scenic easement in favor of the City shall be recorded over all the <br /> open space areas within Lots 1 - 7 as shown in Exhibit "D" -- essentially those <br /> areas of the lots within the tree canopy and including the wetband landscape area <br /> and the graded slope area between the Crosby Drive extension and the EBRPD <br /> open space parcel: This easement shall indicate that no future develop. ment is <br /> permined within these open space areas. The text of this easement shall be subject <br /> to the review and approval of the City Attorney and the Planning Director. <br /> <br />39. The developer shall establish at the time ofrecordation of the Final Map a <br /> maintenance association or other mechanism to maintain the emergency vehicle <br /> access road. The establishment of this association shall be subject to the review <br /> and approval of the City Attorney prior to recordation of the final map. The City <br /> shall have the right to maintain the emergency vehicle access in a manner <br /> satisfactory to its standards should the association fail to do so and the City shall <br /> have the right to assess the association for any costs incurred in such maintenance. <br /> <br />40. The wetband landscape area, the graded slope area between the extension of <br /> Crosby Drive and the East Bay Regional Park District parcel (as defined in Exhibit <br /> E), and the open space area of Lot 6 between the water tank access road and the <br /> Presley property shall be maintained by the individual property owners in a <br /> manner satisfactory to the City and the intent of the PUD wet band landscape plan <br /> and the intent of the PUD design guidelines.
