41. Prior to City Council approval of the Final Map, the developer shall make <br /> provisions for annexation of Lots 1-7 to the Geologic Hazard Abatement District <br /> (GHAD) already established for The Preserve (the residential subdivision adjacent <br /> to the site on the south). The district shall have sole and full responsibility. for the <br /> inspection, repair and continual maintenance of landslides, unstable slopes, <br /> drainage systems, catch basins, siltation ponds, and other geologic hazards. The <br /> annexation to this district shall be subject to the review and approval of the City <br /> Attorney and City Engineer, and shall occur prior to the sale of any lot. <br /> <br />42. Any lands dedicated to the East Bay Regional Park District shall be subject to an <br /> easement satisfactory to the City in favor of the Geologic Hazards Abatement <br /> District (CHAD) and the City to allow for maintenance and repair of geologic <br /> hazards within the open space areas which may affect individual lots, the <br /> emergency vehicle access driveway, the water tank access road, or other facilities <br /> or properties which could be adversely affected. <br /> <br />43. The developer shall grant to the City a public storm drain easement satisfactory to <br /> the City over the storm drain outfall to the swale in the East Bay Regional Park <br /> District open sp.ace area pursuant to Exhibit "A" and as may be extended pursuant <br /> to Condition 11 .d. <br /> <br />44. The developer shall grant an emergency vehicle access and maintenance access <br /> easement to the EBRPD over the existing water tank access road solely for the <br /> purposes mentioned herein. No public access shall be allowed or assumed by <br /> granting this easement. In accepting this easemet, the EBRPD shall agree that the <br /> City. shall have no liability for any injury to persons or property associated with the <br /> EBRPD or its activities within this easement. <br /> <br />45. Prior to or concurrently with Final Map approval, the developer shall grant an <br /> easement to the City and the East Bay Regional Park District over the existing <br /> driveway for emergency vehicle access and maintenance access. <br /> <br />46. Prior to recordation of the final map, all modifications required to the design <br /> guidelines through conditions of approval shall be combined into a single <br /> comprehensive document. This document shall be submitted to the Planning <br /> Director for review and approval prior to publication. The developer or its <br /> successor in interest shall disclose the design guidelines to the lot buyers prior to <br /> close of escrow, and shall provide them with copies of the guidelines. <br /> <br />PUD-98-08 Conditions of Approval <br /> Page B- l 1 <br /> <br /> <br />
