THE CITY OF <br /> Ill II - - <br /> LEASANTON© <br /> MEMORANDUM <br /> Date: August 15, 2018 <br /> To: Mayor and Council <br /> From: Nelson Fialho, City Manager <br /> Larissa Seto, Assistant City Attorney Dy <br /> Subject: Modification to omnibus ordinance: clarify that house numbers and <br /> "No Dumping — Drains to Bay" may be privately painted on curbs <br /> One of the items in the omnibus ordinance is a prohibition of private painting on public curbs. <br /> This is intended to stop confusing private painting of red curbs, yellow curbs, etc. on public <br /> streets. Now, it has been brought to staffs attention that residents desire to paint their house <br /> numbers on the curbs in front of their houses, and local service groups will paint "No Dumping — <br /> Drains to Bay" type messages on public curbs by sewer inlets. <br /> To accommodate this acceptable private paintings on public curbs, the municipal code <br /> amendment is proposed to be modified as follows: <br /> 13.04.050 Prohibited encroachments. The following encroachments are specifically prohibited, and no <br /> applications will be accepted nor permits issued therefor: <br /> A. Construction or maintenance of a loading dock on or in public right-of-way; <br /> B. Erection or maintenance of a post, pole, column or structure for the support of advertising signs; <br /> C. Installation or maintenance of underground tanks, vaults, or elevators, except that underground vaults <br /> may be permitted as part of facilities owned by public utilities or public agencies; <br /> D. Erection, installation or maintenance of posts, poles or columns for the purpose of carrying lights <br /> intended primarily for lighting of abutting private property; <br /> E. Installation or maintenance of signs bearing flashing or moving lights, except for temporary warning <br /> signs, barricades or flashers required for protection or the public during construction operations; <br /> F. Application of paint to paved surfaces, including curbs, except for: <br /> 1. _eOfficial traffic markings and marking of underground facilities in connection with <br /> construction or maintenance work; <br /> 2. House numbers 5 inches in height, with a contrasting background, on the face of a curb <br /> generally near the driveway of the house; and <br /> 3. "No Dumping—Drains to Bay" type message on the top of curb above or generally near a <br /> sewer inlet. <br /> G. Construction or placement of any fill, wall, pipe, column, pole, fence, tree, shrub or any other item <br /> within any right-of-way, or which would constrict and reduce the capacity of any watercourse to carry <br /> stormwater. <br />
