Commissioner Piper inquired if they have furniture from inside the house in the garage <br />because of the flood. <br />Mr. Alioto said yes. <br />Commissioner Piper asked Mr. Alioto whether they parked their cars in the garage or in <br />the driveway or the street when they were operating the small daycare and before his <br />wife applied for the Conditional Use Permit to operate a large family daycare. <br />Mr. Alioto replied that the law requires them to live in the house while operating a large <br />family daycare, and, therefore, the house is not just for the business; there are multiple <br />people living there who are not part of the daycare: his wife runs the daycare, and he <br />and his mother live in the house as well. He added that for that reason, his car and his <br />mother's car are not parked in the garage because it would be difficult for them to leave <br />the house if there were parents parked in the driveway; he and his mother would then <br />typically not park in the garage, but his wife's car might be parked in the garage. <br />Commissioner Piper inquired if they were using the garage as part of their small <br />daycare before the flood occurred. <br />Mr. Alioto replied that they had just moved into the house when they applied for the <br />large family daycare, and they had been operating the small daycare only for some <br />days. <br />Commissioner Piper noted that the Condition No. 4 of the Conditions of Approval <br />requires them to park two cars in the garage. She asked Mr. Alioto what their intention <br />is with the garage. <br />Mr. Alioto replied that they intend to make it available for one car to be parked in there. <br />He stated that they had put in the report that they wanted to make the parking spots in <br />the garage available for the tenants of the house and not necessarily for the daycare <br />because the staff and the parents will not be parking in the garage. <br />Commissioner Piper stated that the occupants of the house currently have two cars at <br />the home and asked Mr. Alioto is it was their intention to park the cars in the garage <br />since it is part of the Conditions of Approval. <br />Mr. Alioto replied that he did not think it is the idea of the Commission or staff to require <br />them as owners or tenants of the home to park in the garage; that the intent is not to <br />force them to park in the garage but to ask them to make the garage available for them <br />to park there. <br />Commissioner Piper requested staff to comment on that. <br />Ms. Harryman replied that the applicant is making a good point and that the <br />Commission can consider the language of Condition No. 4, which reads: "The garage <br />shall remain available for parking of two vehicles, as required by the Pleasanton <br />Municipal Code. A business license shall not be issued until the garage is clear and <br />available to park two vehicles and renovations are complete to the satisfaction of the <br />PLANNING COMMISSION MINUTES, October 14, 2015 Page 23 of 35 <br />
