Commissioner Pearce moved to make the required Conditional Use Permit <br />findings as listed in the staff report and to approve Cases P12 -0556 and P12 -0557, <br />subject to the Conditions of Approval, Exhibit A of the staff report, with the <br />addition of the following new conditions: <br />1. Allow unobstructed view of the interior of market, per staff's memo, dated <br />March 27, 2013. <br />2. Require commercial sweeping of the exterior property once a week. If the <br />maintenance of the exterior is insufficient, more frequent maintenance and <br />cleaning may be required as necessary, at the discretion of the Director of <br />Community Development. <br />3. Require regular maintenance of the fence and mitigation of any graffiti on <br />that fence within a reasonable period of time. <br />4. No audio /video commercials /advertising attached to the fuel dispensers. <br />Commissioner Narum seconded the motion. <br />Chair Blank suggested a modification to the graffiti condition to add "as <br />determined by the Director of Community Development' after "within a <br />reasonable period of time." <br />Commissioner Narum suggested a modification to have the convenience store <br />employees park at the south end of the lot on the site. <br />Commissioner Pearce agreed that the parking be on -site but farther away from the <br />mini -mart. <br />Commissioner Posson proposed two modifications: (1) Condition No. 6 to add <br />that the applicant shall prevent loitering, and (2) Condition No. 13 to add that the <br />operator shall request fuel deliveries to occur between the hours of 6:00 a.m. and <br />9:00 P.M. <br />Commissioner Pearce suggested that the modification to Condition No. 6 use the word <br />"discourage" rather than "prevent" as prevention sounds a little bit violent. <br />Commissioners Pearce and Narum accepted the amendments. <br />Commissioner O'Connor inquired if there was support for changing the start time to <br />6:00 a.m. <br />Commissioner Narum suggested that Commissioner O'Connor try for a modification or <br />an amendment. <br />Commissioner O'Connor presented a friendly amendment to modify the start of <br />the hours of operation from 5:00 a.m. to 6:00 a.m.. <br />Commissioner Olson stated that he thinks the start time should be left at 5:00 a.m.. <br />PLANNING COMMISSION MINUTES, March 27, 2013 Page 23 of 48 <br />
