Commissioner Pearce stated that she was concerned about modifying the business <br />plan too much. She indicated that the Commission cut it back a little bit, but it turns out <br />there is a major problem with noise or things like that, or any of the issues that were <br />discussed. She noted that traffic has been mitigated, as well as noise, loitering, and the <br />trash. She indicated that she does not know that she wants to automatically say that <br />the applicant needs to go to 6:00 a.m. and take issue with their business plan to <br />mitigate the impacts. <br />Chair Blank stated that he did a quick calculation on the ceiling tiles and thinks that the <br />Council Chamber is a bit larger than 1,000 square feet. He added that as one who <br />sometimes commutes early in the morning, he can say that there are a lot of cars in a <br />lot of gas stations, including himself, sometimes at 5:30 a.m., so he is personally a little <br />concerned about over - engineering the business plan. <br />Commissioner Olson stated that that is a key revenue hour for this business, and <br />changing the start time to 6:00 a.m. would be messing with the owner's revenue. <br />Commissioner Narum proposed to leave the start time as is, and the applicant will need <br />to meet a decibel level at the property line; and if there are noise complaints, the matter <br />will come back to the Commission. She stated that to change the hours at that point if <br />there is a problem complying with the noise ordinance may be the mitigation then. <br />Chair Blank agreed that there is a mechanism for that. <br />Commissioner Pearce agreed. She indicated that she would rather allow it to start <br />earlier and then pull it back, if necessary. <br />Commissioner Narum agreed, given that there are ways to mitigate or not mitigate: to <br />measure the issue and then mitigate it, if necessary. <br />Chair Blank stated that it does not sound like there is support for the friendly <br />amendment. He indicated that the maker and the second declined the modification, <br />and the other option is to amend the motion and see if there is a second. <br />Commission O'Connor withdrew his friendly amendment.
