E. Installation or maintenance of signs bearing flashing or moving lights, except for temporary <br /> warning signs, barricades or flashers required for protection or the public during construction <br /> operations; <br /> F. Application of paint to paved surfaces, including curbs, except for official traffic markings <br /> and marking of underground facilities in connection with construction or maintenance work; <br /> G. Construction or placement of any fill, wall, pipe, column, pole, fence, tree, shrub or any other <br /> item within any right-of-way, or which would constrict and reduce the capacity of any <br /> watercourse to carry stormwater. <br /> In Chapter 13.08 PARKS AND RECREATION FACILITIES, §13.08.190 is amended as follows: <br /> 13.08.190 Smoking. <br /> A. No person shall smoke anywhere within any park or recreational facility. as defined in <br /> Section 13.08.020.0 and includes trails along the arroyos, except within the outdoor areas of the <br /> Callippe Preserve Golf Course. Public sidewalks adjacent to park and recreational facilities are <br /> not subject to this prohibition, but pathways through such park and recreational facilities as well <br /> as adjacent City-owned public parking lots are subject to this prohibition. <br /> B. No person shall smoke in any enclosed building in a park and recreational facility except as <br /> provided in Chapter 9.24 of this code. <br /> CB. A renter of a park or recreation facility Downtown shall prohibit smoking during such <br /> rental. "No Smoking" signs shall generally be visible at entrances or reasonable intervals along <br /> the perimeter of such rental to advise guests, invitees and the public about such prohibition on <br /> smoking. Violators are subject to administrative citation as provided in Chapter 1.24. <br /> DC. "Smoking" is defined as set forth in Section 9.24.020(P). <br /> ED. "Downtown" is defined as the area within the Downtown Specific Plan. <br /> In Chapter 17.16 TREE PRESERVATION, §17.16.006, §17.16.010, §17.16.040, §17.16.050, <br /> §17.16.070, and §17.16.080 are amended as follows: <br /> 17.16.006 Definitions. <br /> For the purpose of this chapter, certain words and terms used in this chapter are defined as follows: <br /> A."Heritage tree" means a tree of any species or origin which meets any of the following: <br /> I. Any single-trunked tree with a circumference of 55 inches or more measured four and <br /> one-half feet above ground level; <br /> 2. Any multi-trunked tree of which the two largest trunks have a circumference of 55 inches <br /> or more measured four and one-half feet above ground level; <br /> 3. Any tree 35 feet or more in height; <br /> 4. Any tree of particular historical significance specifically designated by official action; <br /> 7 <br />
