It was moved by Councilman McWilliams and seconded by Councilman Bubics that <br />the reading of Ordinance No. 447, be waived. <br />The roll call vote was as follows: <br />AYES: Councilmen Bubics, Gerton, Harding, McWilliams and Mayor Long <br />NOES: None <br />ABSENT: None <br />Amendment to the General Plan re: neighborhood park and recreation facility <br />standards <br />Mayor Long declared the public hearing on the above matter, open. <br />Mr. Fales read the report of the Planning Commission which recommended the <br />amendment of the General Plan requiring the dedication of land for neighborhood <br />parks and the payment of fees to be used for the development of that land as it <br />is the intent of the City to require either land or fees in whatever ratio is re- <br />quired to carry out the intent of the General Plan. <br />It was moved by Councilman Gerton and seconded by Councilman McWilliams that <br />the public hearing be closed. <br />The roll call vote was as follows: <br />AYES: Councilmen Bubics, Gerton, Harding, McWilliams and Mayor Long <br />NOES: None <br />ABSENT: None <br />It was moved by Councilman Gerton and seconded by Councilman McWilliams that <br />Resolution No. 66 -30, amending the General Plan to provide for clarifying language <br />in the Parks and Recreation element of the General Plan regarding Neighborhood <br />Park and Recreation Facility Standards and referring to the Park Dedication Ordi- <br />nance of the City of Pleasanton, be adopted.. <br />The roll call vote was as follows: <br />AYES: Councilmen Bubics, Gerton, Harding, McWilliams and Mayor Long <br />NOES: None <br />ABSENT: None <br />CONTINUED FROM MARCH 7, 1966, FOR DECISION: APPEAL OF SHELL OIL CO. <br />Mr. Fales reviewed the past action and recommendations of the Planning Commis- <br />sion and the Staff Reports which listed a number of specific conditions to be con- <br />sidered. <br />Mr. Douglas Safreno, property owner, and Mr. Dan Christopoulis, representing <br />the Shell Oil Co., displayed both revised site plans. <br />Both Mayor Long and Councilman Harding stated that they were opposed to grant- <br />ing a Conditional Use Permit as construction of a service station in immediate <br />proximity to the existing multiple dwellings located on the parcel immediately <br />south of the parcel in question would be in violation of the Zoning Ordinance. <br />It was moved by Councilman Gerton and seconded by Councilman Bubics that <br />Resolution No. 66-31, granting a Conditional Use Permit to the Shell Oil Company <br />be adopted and the matter be referred to the Planning Commission to include the <br />following terms and conditions for site plan details. <br />a. Application for details of site plan, architectural and landscaping <br />approval shall be shown on applicant's plan, and subject to any <br />reasonable conditions as fixed by the Planning Commission. <br />b. The applicant or owner, Douglas Safreno, shall apply for rezoning <br />of the parcel to the south, changing the district from C -0 to C -T. <br />c. Applicant or owner, Douglas Safreno, shall combine legal descrip- <br />tions of proposed site and southerly parcel into one description, <br />so as to come under the jurisdiction of the Subdivision Committee <br />in the event of any future lot- split. The purpose of this provision <br />is to prevent the southerly parcel being used to meet lot area <br />requirements for any future application of adjacent property. <br />The roll call vote on Resolution No. 66 -31 was as follows: <br />AYES: Councilmen Bubics, Gerton and McWilliams <br />NOES: Councilman Harding and Mayor Long <br />ABSENT: None <br />REPORTS OF BOARDS AND COMMISSIONS <br />Report of the Planning Commission re: Rezoning Application of 3. W. Shackelton and <br />W. W. Allison <br />Mr. Fales reviewed the report of the Planning Commission, dated March 11th, <br />and the staff report, dated March 9th, and recommended that the public hearing be <br />held on March 28th. <br />It was moved by Councilman Harding and seconded by Councilman McWilliams that <br />the public hearing on the rezoning application of J. W. Shackelton and W.
