Response to Code Enforcement Officer Mark Dennis' Letter to the Millers <br />Dated March 31, 2016 <br />. 1) CUP — Condition 111 does prohibit use of the backyard contrary to your statement: <br />Condition tt1: "the guiding standards for the development of the site shall be that ... the <br />buildings be designed so that activities will be focused toward the southern portion of <br />the subject property..." <br />During the party on March 24 the backyard area on the north had several tables set up with food, <br />blankets for people to sit on. and trashcans for the paper plates on which they were eating. The <br />tables, blankets, and trashcans were all set up on the north side in the backyard and none of these <br />things were set up on the south side. Therefore, a reasonable person would conclude that there was <br />a clear focus on the north and no focus on the south. That is, this event was not "focused toward the <br />southern portion of the subject property," which is a dear violation of Condition Ill. <br />Also, we have evidence of this if you would like to request it. <br />Please respond with your feedback. <br />2) CUP — Condition #20 does prohibit use of the backyard contrary to your statement. <br />Condition 1120: "that the applicant provide an effective buffer between the development <br />and the single family residential area surrounding the property." <br />Planner Donna Decker, in an email to the Millers, defined the "buffer" as the backyard area. <br />Also, the Minutes from the 1977 Commission Hearing state, <br />"Commissioner Shepherd requested that some wording be inserted to safeguard the <br />residents from the facility, by means of buffering." <br />In the event on March 31, 2016, people used the backyard.
