3. The mixed-use space in Residence 1, labeled as "MU" on the floor plan of Exhibit <br /> B, shall not be used, converted, and/or altered for residential use. The MU space <br /> shall be required to meet all applicable building and fire codes. <br /> 4. No additions or expansions are permitted to any structure. Future building and/or <br /> site improvements not covered by this development plan approval shall be subject <br /> to City review and approval prior to any changes to the building(s) and/or site. <br /> 5. Accessory structures are not allowed. <br /> 6. Prior to submitting a Parcel Map or issuance of a building permit from the Building <br /> and Safety Division, the applicant/property owner shall enter into a license <br /> agreement with the City for the roof eave encroachment of the mixed-use building <br /> into the City right-of-way, the language of which shall be subject to the review and <br /> approval by the City Attorney. <br /> 7. The roofing material of all the buildings shall be standing seam metal. All <br /> applicable plan sheets shall be revised and included in the plans submitted to the <br /> Building and Safety Division for plan check and permit issuance and shall be <br /> subject to the review and approval of the Community Development Director prior <br /> to issuance of building permits. <br /> 8. Fencing within the development shall conform to the approved development plan <br /> on file with the Planning Division (Exhibit B). Minor modifications to the fencing <br /> plan may be approved by the Director of Community Development without a PUD <br /> modification. <br /> 9. All signage for the commercial/retail/office spaces of the mixed-use building and <br /> Residence 1 shall confirm to the requirements of the Pleasanton Municipal Code, <br /> Downtown Revitalization District requirements, and the Downtown Design <br /> Guidelines. The applicant shall submit a final comprehensive signage package for <br /> said buildings and site for review and approval by the Planning Division prior to <br /> installation of any signs. <br /> 10. Prior to issuance of a building permit, the applicant shall submit a finished stucco <br /> sample for the buildings. The stucco sample shall be subject to the review and <br /> approval of the Director of Community Development prior to application/installation <br /> on the buildings. Stucco shall be smooth and hand-troweled. <br /> 11. The project developer/subdivider shall create the applicable access, use, <br /> maintenance, etc., easements for the private street, and parking lot, subject to the <br /> review and approval of the City Attorney and Director of Community Development <br /> prior to occupancy of any structure. <br /> PUD-118 & P16-0203 4791 Augustine Street <br /> Draft Conditions of Approval 2 of 27 Mixed-Use Development <br />
