concerns regarding dust control or other components of the project. Temporary <br /> construction fencing and a portable comfort station were set up on the site on July 21. <br /> On Thursday and Friday, July 21 and 22, City Engineering staff began hearing concerns <br /> from area residents about the construction of the courts scheduled to start on July 25. <br /> Over the weekend (July 23 and 24) the resident's concerns intensified. In response to <br /> those concerns raised about the construction of the tennis courts, a special City Council <br /> meeting was scheduled for August 9 to receive input from the community. The contractor <br /> was notified to not begin work in the park on July 25, and to suspend all work on the <br /> project until the City Council provides additional direction. <br /> DISCUSSION <br /> Due to the long history of planning for the Tennis and Community Park, and these two <br /> courts being the final phase of the park, there were no recent efforts to seek nearby <br /> neighborhood's input regarding the location of the tennis courts within the park. <br /> Staff believes there are three basic alternatives available to City Council: <br /> 1. Continue with the project as currently planned to construct the two additional tennis <br /> courts as shown in Attachment 1. <br /> 2. Eliminate the consideration of two additional tennis courts at the Tennis and <br /> Community Park at this time. <br /> 3. Direct staff to further study other potential locations in the Tennis and Community <br /> Park to construct two additional tennis courts, including the three potential <br /> alternatives discussed below and shown graphically in Attachments 2, 3, and 4. <br /> Continuing Work as Planned or Cancelling the Contract <br /> Continuing with the project as designed and bid would allow the contract work to proceed <br /> with some minor cost impacts associated with the suspension of work. Field work would <br /> need to start immediately to complete the project by this fall. If the City Council chooses <br /> not to build the additional tennis courts at this time, or directs staff to consider alternative <br /> locations for the courts within the park, the construction contract with Goodland <br /> Landscaping will be cancelled. If the contract is cancelled, staff will negotiate with <br /> Goodland the cost of the work they have performed to date. Please keep in mind that <br /> work has been performed other than the actual field work in the park. For example, the <br /> contractor has purchased required bonds and insurance, entered into subcontracts, <br /> arranged and ordered material and equipment, etc. The contractor may also seek <br /> anticipated profit on the project to which they may be entitled, especially true if they can <br /> demonstrate lost opportunities for other work because they expected to perform this <br /> contract. Staff believes the contractor will negotiate these costs in good faith, and the <br /> final amount will be manageable, but it is pointed out here so that City Council is aware it <br /> is not as simple as cancelling a contract with no cost because there has been little actual <br /> field work accomplished. <br /> It should also be noted that the installation of the tennis court playing surface is <br /> temperature dependent.
