3. CASTLERIDGE TRAILHEAD IMPROVEMENTS. The Castleridge Trailhead improvements <br /> (hereafter"Improvements") include: <br /> a. Old Foothill Road improvements including, but not limited to, grading, new <br /> pavement, asphalt concrete pads, asphalt concrete pedestrian paths, storm drainage <br /> improvements, painting parallel parking spaces, and signage, as generally shown in the <br /> attached Exhibit A. <br /> b. A crushed rock pedestrian walk as generally shown in the attached Exhibit A. <br /> c. Roadway improvements at the intersection of Foothill Road and Jerlin Place as <br /> generally shown in the attached Exhibit A. <br /> d. Installation, operation and maintenance of a vault toilet(e.g. no running water) in an <br /> accessible restroom of generally the type shown in the attached Exhibit B, at a <br /> location to be determined by City. <br /> e. Installation of water fountain near trailhead. <br /> f. Installation of a driveway gate for the Messa and Segunda property owners of a type <br /> of gate mutually agreed upon by District, Messas and Segundas; and at a location <br /> mutually agreed upon by District, City, Messas and Segundas. <br /> g. The Improvements described in Subsection a. to e., above, shall be designed by City <br /> or City's agent's and constructed by District or District's agents according to City <br /> Standards and Specifications, unless otherwise approved in writing by the City <br /> Engineer or designee. <br /> h. All construction of Improvements described in Subsections a. to e., above, shall be <br /> subject to District or District's agent obtaining a City encroachment permit, as well <br /> as City inspection. City shall waive fees associated with encroachment permit and <br /> inspection. <br /> i. City shall provide compliance with CEQA and any necessary permits associated with <br /> construction of Improvements described in Subsections a. to e. <br /> j. The Castleridge Trailhead Improvements shall be completed within one year from <br /> execution of this MOU. <br /> 4. CASTLERIDGE TRAILHEAD LICENSE/Lease. After the final design of the Improvements <br /> described in Section 3, Subsections a. to e., the parties shall mutually agree on the terms of <br /> a license Agreement for District to: utilize City property, commonly known as the Austin <br /> Triangle shown in the attached Exhibit C (hereafter"Austin Triangle") for District's trail <br /> connecting Foothill Road to District's existing trail further up Pleasanton Ridge Regional <br /> Park; and for District's vault toilet described in Section 3.d., above. <br /> 3 <br />
