a. City shall execute and deliver the License Agreement to District upon: <br /> i. City final inspection of the Improvements described in Section 3, Subsections <br /> a. to e., above.; and <br /> ii. District updating the City regarding District's progress on milestones for the <br /> Garms Staging Area described in I.a., above. <br /> b. Upon completion of the Garms Staging Area, the parties shall mutually agree on the <br /> terms of an easement for the trail access over the Austin property and a long-term lease (say <br /> 25 years) for the trailhead area, including the vault toilet, on the Austin property. These <br /> documents shall replace the License Agreement <br /> 5. CASTLERIDGE TRAILHEAD MAINTENANCE. After completion of the construction of <br /> the Improvements, District shall maintain: <br /> a. The trail improvements on the City's Austin Triangle; <br /> b. The vault toilet; <br /> 6. PARKING ON OLD FOOTHILL ROAD. Parking in designated areas on Old Foothill Road <br /> shall be subject to the Pleasanton Municipal Code Chapter 1 1.40 as it may be amended <br /> from time to time, and maybe reserved for scheduled events at the Alvis Adobe <br /> Community Park with appropriate signage posted at least 24 hours in advance of the event <br /> 7. CASTLERIDGE TRAILHEAD ADDITIONAL PARKING. The parties agree that if public <br /> demand is greater than the available supply of parking spaces along the improved Old <br /> Foothill Road, the parties may consider amending this Agreement to provide for additional <br /> public parking on the City's Austin property. Any such additional parking shall be mutually <br /> agreed upon by the parties. If additional parking is agreed to by the parties, District agrees <br /> to pay for construction of additional parking subject to its Board of Director's authorization <br /> of funding and so long as City provides an easement or long-term lease free of charge. <br /> 8. RULES OF USE. The public will be subject to the rules and regulations which each agency <br /> enforces on its own property (whether it be property held in-fee, or easement or lease <br /> agreement as contemplated herein). The trail, District staging areas and licensed or leased <br /> areas shall be subject to the District's Ordinance 38. Each agency will inform the other of <br /> changes to park rules in advance and discuss possible modifications of park rules to reduce <br /> confusion for park users and to facilitate enforcement. <br /> 9. PUBLIC SAFETY. The respective law enforcement departments of each agency shall <br /> cooperate with each other; the fire departments of each agency shall maintain regular <br /> communication with respect to fire prevention and suppression issues in the parklands. <br /> 4 <br />
