I. GARMS STAGING AREA. <br /> a. District has currently developed and approved preliminary plans for the Garms <br /> Staging Area and completed CEQA analysis for the project on July 17, 2012. <br /> District's next steps and expected dates for completion of milestones for the Garms <br /> Staging Area include: <br /> i. Completion of Detailed Design Plans -July 2018 <br /> ii. Issue Bid— December 2019 <br /> iii. Complete Construction— December 2020 <br /> b. District shall diligently pursue the steps and dates for completion of the milestones <br /> set forth above. <br /> c. District shall advise City by telephone or electronic mail to: Brian Dolan, Assistant <br /> City Manager, 925.931.5002 or bdolan©cityofpleasantonca.gov regarding any <br /> District public meeting, hearing,award of bid or contract, or other milestone related <br /> to District's development of and progress on the Garms Staging Area. <br /> d. District agrees to diligently pursue completion of the Garms Staging Area in <br /> accordance with the milestones set for the above. The milestone to issue bid and <br /> enter into a contract for construction is subject to the District Board approving <br /> funding for the project. <br /> e. District's failure to meet milestones for the Garms Staging Area set forth in 1(a) <br /> above, may be the basis for City declaring Breach of this Agreement. <br /> 2. GARMS STAGING AREA ROADWAY IMPROVEMENTS. <br /> a. District's design for the Garms Staging Area requires ingress and egress from <br /> Foothill Road with a modified signalized intersection at West Las Positas Boulevard, <br /> including headwalls, left turn lanes and signal modifications, as well as improvements <br /> to Highlands Oaks Drive. <br /> b. City will cooperate with District in the review and approval of traffic improvement <br /> designs to serve the Garms Staging Area. The Parties acknowledge that such <br /> cooperation does not limit City's discretion to require that any improvements meet <br /> City Standard Specifications and traffic circulation requirements. City will agree to <br /> waive fees for necessary review and permitting for work in City right-of-way. <br /> 2 <br />
