IAll employees in classifications listed in Section 1.0, who are members of <br /> AFSCME and who are tendering periodic dues through dues deductions from their <br /> paycheck, and all employees who become members of AFSCME and who tender <br /> periodic dues through dues deductions from their paycheck, shall continue to pay dues for <br /> the duration of this MOU and each subsequent MOU thereafter. <br /> For a period of thirty (30) calendar days prior to the expiration of the current MOU, any <br /> employee who is a member of AFSCME shall have the right to withdraw from the Union <br /> by discontinuing dues deduction. Said withdrawal shall be communicated by the <br /> employee in writing to the President, Vice-President or Secretary/Treasurer. It will then <br /> be forwarded to the Director of Finance and processed through the payroll system. Such <br /> written communication shall be delivered by certified mail and must be postmarked <br /> during the thirty(30) calendar day period. An employee who so withdraws from Union <br /> membership shall still be subject to the provisions of Agency Shop. <br /> An employee who is subsequently employed in a position outside of the unit represented <br /> by the Union shall not be required to pay dues to the Union. <br /> 2.2.2 Agency Shop and Eligibility/Exemptions <br /> All employees in the classifications listed in Appendix B shall, as a condition of <br /> continued employment, become members of the PCEA/AFSCME LOCAL 955, or shall <br /> pay a service fee equal to the monthly dues of the PCEA/AFSCME LOCAL 955. This <br /> agency shop agreement shall continue for as long as PCEA/AFSCME LOCAL 955 <br /> remains the exclusive representative of the classifications in the bargaining unit listed in <br /> Appendix B. <br /> a. Exemptions: <br /> Any employee who is a member of a bona fide religious body or sect which has <br /> historically held conscientious objections to joining or financially supporting <br /> employee organizations shall not be required to join or financially support the <br /> Union as a condition of employment. Such employees shall be required, in lieu of <br /> periodic dues, initiation fees, or agency shop fees to pay an amount equal to the <br /> periodic dues, initiation fees or agency shop fees to a non-religious tax-exempt <br /> charity,three such organizations to be mutually agreed upon by the parties. <br /> b. Compliance: <br /> 1. An employee in one of the classes included in Appendix B shall (and in the <br /> case of a newly hired employee, within thirty(30) calendar days of employment) <br /> execute a payroll deduction authorization form furnished by the Union, and <br /> thereby become and remain a member in good standing in the Union; or execute a <br /> payroll deduction authorization form and thereby pay to the Union a service fee <br /> equal to the monthly dues of the Union. In the case of employees who certify that <br /> they are members of a bona fide religion, body or sect which has historically held <br /> conscientious objections to joining or financially supporting public employee <br /> -6 - <br />
