this type in the downtown area of Pleasanton 309 Neal Street is also associated with <br /> the history of civic development and medicine in Pleasanton as a hospital site in the <br /> early twentieth century However, the property has lost association with this context <br /> with reconversion to residential use in the 1930s The property is not associated with <br /> persons significant in the history of Pleasanton " <br /> a Museum or Public Building In terms of City land use regulations, 309 Neal <br /> Street is located in a Residential One-Family zoning district known as R-1-6500 1 As an <br /> existing residence in a one-family zoning district, museums, public buildings, and offices <br /> are not an allowed use (see Municipal Code §18 32 030, 18 32 040, and 18 32 050 A) <br /> 309 Neal Street is surrounded by other one-family residences If the City wants to <br /> consider converting the house to a public museum, or offices for a non-profit as desired <br /> by Ms Jones, the City would need to <br /> (a) undertake an environmental review of potential impacts due to parking, noise, <br /> etc arising from a change to public or commercial activities in a residential <br /> district, <br /> (b) consider a General Plan amendment and re-zoning, and <br /> (c) analyze the site and required building upgrades for public safety and <br /> accessibility <br /> Because of the use of the home for the past 84 years as a residence, its brief 2-3 years <br /> as a hospital, the surrounding residential neighborhood, and current condition of the <br /> home, staff recommends that the City Council maintain 309 Neal Street as a one-family <br /> home <br /> b Official Designation Maintaining 309 Neal Street as a one-family home still <br /> allows the City to consider Ms Jones' desire that it be `officially designated an historical <br /> site by the City of Pleasanton" The General Plan's Conservation and Open Space <br /> Element, Table 7-3, includes a list of Historic Neighborhoods and Structures It is <br /> recommended that the Council direct staff to include 309 Neal Street in that General <br /> Plan list (and related Figure 7-3) during the next General Plan amendment <br /> c Sale to Private Party with Conservation Easement While Ms Jones' will <br /> expressed her preference that the house be used as a museum for local history or an <br /> office for a historic society, her will does provide other options for the sale of the <br /> property subject to "an historic restoration obligation and/or conservation easement <br /> such that the home itself cannot be demolished or removed so as to eliminate all <br /> historic significance " Ms Jones' conservation interests can be achieved by applying to <br /> 309 Neal Street both (1) a conservation easement prohibiting demolition of the <br /> residence2, and (2) a conservation easement making any exterior modifications, <br /> alterations or additions subject to design review approval set forth in Municipal Code <br /> §18 20 010 B 15 (which was adopted in November 2015 to apply to homes in the <br /> 'While there is a 6,500 s f minimum lot size for this zoning district, this parcel is 16,878 s f <br /> 2 It is specifically recommended that the prohibition on demolition apply to the residence, but not to the <br /> barn in the event that further structural analysis of the barn determines that there are safety concerns <br /> Page 4 of 6 <br />
