Downtown Specific Plan Area built before 1942) A conservation easement to ensure <br /> these preservation interests in perpetuity is being developed by Mr MacDonald, and is <br /> recommended to be subject to the approval of the City Attorney, Director of Community <br /> Development and City Manager <br /> If the Council adopts staff's recommendation for the sale of 309 Neal Street to a private <br /> party subject to the conservation easement, Mr MacDonald will prepare a marketing <br /> plan, recommended to be subject to the approval by the City Manager, that includes (a) <br /> reduced realtor commission, and (b) a set opening date for proposals that includes <br /> consultation with the City Manager's designee As the property is currently part of Ms <br /> Jones' estate, with the City as the beneficiary, the City is not legally the owner of the <br /> property As such, the sale of the property is not subject to typical State laws regarding <br /> City disposition of assets (e g , offer to affordable housing groups in the county, etc ) <br /> Mr MacDonald proposes, and City staff concur, that a real estate broker should be <br /> utilized to ensure compliance with complicated State laws regarding the sale of <br /> residences in California <br /> 2 Estate proceeds As the executor's report indicates, Ms Jones' estate after probate <br /> costs and other expenses will total about $291,000, plus the estimated $1,000,000 <br /> value of 309 Neal Street if sold to a private party with covenants as described herein <br /> Ms Jones' will states that "Upon termination of the trust, the remaining trust assets shall <br /> be distributed outright and free of trust to the City of Pleasanton and used for <br /> historical building preservation purposes " The Council has discretion to determine how <br /> to use the estate proceeds in support of Ms Jones' intentions <br /> a Endowment for Amador Livermore Valley Historical Society The executor's <br /> report proposes, and staff supports, the use of estate proceeds to create an endowment <br /> with the Amador Livermore Valley Historical Society (ALVHS) The ALVHS is a <br /> recognized tax-exempt organization that operates the Museum on Main, a local history <br /> museum, and was specifically named in Ms Jones' will as an organization that should <br /> be consulted The ALVHS's Endowment Fund Resolution (Attachment 4) limits annual <br /> distributions, requires reporting to the City Manager, and limits expenditures to support <br /> the programs of the ALVHS and Museum on Main This support of an organization <br /> dedicated to local history in a historic building is in furtherance of Ms Jones' wishes <br /> 3 Acknowledgment of Ms Jones Given Ms Jones and her family's history with <br /> Pleasanton, 309 Neal Street being Pleasanton Hospital, and Ms Jones' generous <br /> donation of her estate for the public benefit, staff recommends that Ms Jones also be <br /> publicly acknowledged <br /> a Plaque at 309 Neal Street Staff recommends that an easement be created at <br /> 309 Neal Street, then a plaque commemorating Ms Jones and the Pleasanton Hospital <br /> be designed and installed so that pedestrians can read about the history of Ms Jones <br /> and the building The cost of such plaque can be paid from the estate proceeds, and <br /> design and installation managed by the ALVHS with approval from the City of <br /> Pleasanton <br /> Page 5 of 6 <br />
