Councilmember Brown thanked the City Attorney and commented to the City Manager that when she <br /> looked it up she believes that the Council action on November 2012 was to provide guidance so that <br /> the Planning Commission could work on a Municipal Code amendment and come back to the Council, <br /> and that's why there was not two readings of the ordinance and that was correct. She thanked the <br /> community for coming and voicing their opinions and for getting involved and speaking up for their <br /> neighborhoods. She holds that dearer to her than anything else, your neighborhood, your community, <br /> your quality of life, you need to stand up for it and come to these meetings and speak. <br /> MOTION: It was m/s by Olson/Thorne to waive first reading and introduced Ordinance No. 2133 <br /> approving a Planned Unit Development (PUD) Rezoning and Development Plan approval to construct <br /> 48 single-family, two story homes and related improvements on the approximately 194.7-acre Lund <br /> Ranch II property located at 1500 Lund Ranch Road at the end of Lund Ranch Road as recommended <br /> and amended as follows: (1) modify the proposed site plan to reflect the site plan presented by the <br /> applicant at the December 1, 2015 City Council meeting consisting of 48 units: 29 units accessed by <br /> Sunset Creek, and 19 units accessed by Lund Ranch Road; (2) Circulation between the two <br /> neighborhoods shall be permanently (in perpetuity) separated, with through access available only to <br /> pedestrians, bicycles and emergency vehicles. The applicant shall work with City staff on a suitable <br /> physical barrier, beyond just bollards, to ensure it appears permanent, and is nicely landscaped and <br /> attractive; (3) The applicant shall work with City staff to locate the road connection to Sunset Creek <br /> Lane to the least environmentally significant alignment and to minimize grading to greatest extent <br /> possible. In this case, relative to the requirements of Measure PP, the City Council considers this road <br /> to be infrastructure and not a structure; (4) Ensure that all housing structures are outside the 100' foot <br /> vertical setback line. On the southwest edge of the site, the vertical setback shall be measured from a <br /> ridge that ends at the 580' elevation, as originally mapped; (5) If the City Council's interpretation of <br /> Measure PP or project approval is successfully challenged legally, the entire project approval (including <br /> this motion) is considered null and void, and must return to the Planning Commission and City Council <br /> for further consideration consistent with the terms of the Development Agreement; and (6) Growth <br /> management allocations for the project shall be over two consecutive years (2016 and 2017), adopted <br /> Resolution No. 15-809 approving the Affordable Housing Agreement; waived first reading and <br /> introduced Ordinance No. 2134 approving the Development Agreement to vest entitlements for the <br /> project; adopted Resolution No. 15-810 certifying the Final Environmental Impact Report (EIR) <br /> prepared for the project, adopted Resolution No. 15-811 approving the CEQA Findings and Mitigation <br /> Monitoring and Reporting Program and adopted Resolution No. 15-812 approving the Growth <br /> Management Agreement with allocations for the project being over two consecutive years, 2016 and <br /> 2017. Motion passed by the following vote: <br /> Ayes: Councilmembers Narum, Olson, Mayor Thorne <br /> Noes: Councilmember Brown <br /> Absent: Councilmember Pentin <br /> MOTION: It was m/s by Olson/Narum to direct staff to work with neighbors in the Junipero and <br /> Independence neighborhoods on traffic calming solutions and specifically explore restrictions on <br /> AM/PM peak cut-through traffic at the intersection of Bernal and Independence; direct staff to work with <br /> the County of Alameda to explore elimination of the Happy Valley bypass road in coordination with the <br /> comprehensive annexation of all ,or parts of the Happy Valley area; direct staff to add to the City <br /> Council work plan the mapping of ridges in southeast hills within one year's timeframe for review and <br /> consideration by the City Council. <br /> Councilmember Olson noted that this idea has been floated around for a while and has not been done. <br /> He believes we need to define the universe and need to define where the ridges are and where they <br /> are not. He noted the traffic calming that was discussed several years ago on Junipero and that it was <br /> clear this task was something that could be started right away and did not have to wait until the Lund <br /> Ranch II project began, as the current conditions are not working. <br /> City Council Minutes Page 13 of 16 December 1, 2015 <br />
