ATTACHMENT 1 <br /> ORDINANCE NO. <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> APPROVING THE APPLICATION OF FIRESIDE INVESTORS, LLC FOR <br /> PLANNED UNIT DEVELOPMENT (PUD) REZONING AND DEVELOPMENT <br /> PLAN APPROVAL AS FILED UNDER CASE PUD-107 <br /> WHEREAS, Fireside Investors, LLC has applied for Planned Unit Development <br /> (PUD) Rezoning of the approximately 0.25-acre property located at 377 St. Mary Street <br /> from the C-C (Central Commercial), Downtown Revitalization, Core Area Overlay <br /> District to a PUD-HDR/C-C, Downtown Revitalization, Core Area Overlay District, and <br /> for PUD Development Plan approval to convert the existing single-family residence into <br /> a commercial use building including site and exterior building modifications, and to <br /> construct three detached single-family residences ("the Project"); and <br /> WHEREAS, at its public hearings on November 18, 2015, the Planning <br /> Commission adopted Resolution No. PC-2015-39, determining that the proposed <br /> Rezoning and Development Plan are appropriate for the site, making findings, and <br /> recommending to the City Council that PUD-107 be approved; and <br /> WHEREAS, on December 15, 2015, the City Council held a duly noticed public <br /> hearing on the application and considered all public testimony, agenda report, and <br /> related materials, and the recommendations of City staff and the Planning Commission; <br /> and <br /> WHEREAS, the City Council finds that the proposed PUD Rezoning and <br /> Development Plan are consistent with the City's General Plan and purposes of the PUD <br /> Ordinance. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> DOESHEREBY ORDAIN AS FOLLOWS: <br /> SECTION 1. Approves the Rezoning of the approximately 0.25-acre property <br /> located at 377 St. Mary Street from the C-C (Central Commercial), Downtown <br /> Revitalization, Core Area Overlay District to a PUD-HDR/C-C, Downtown Revitalization, <br /> Core Area Overlay District. <br /> SECTION 2. The Zoning Map of the City of Pleasanton, dated April 18, 1960, on <br /> file with the City Clerk, designating and dividing the City into zoning districts, is hereby <br /> amended by Zoning Unit Map No. 496, attached hereto as Exhibit B, dated December <br /> 15, 2015, and incorporated herein by this reference. <br /> SECTION 3. Approves Case PUD-107, the application of Fireside Investors, <br /> LLC for Planned Unit Development (PUD) Development Plan approval to convert the <br /> existing single-family residence into a commercial use building including site and <br /> exterior building modifications, and to construct three detached single-family residences <br />
