For more recent actions regarding smoking restrictions5, the following is a chronological <br /> outline, including smoke-free policies for the City's senior housing developments: <br /> Oct. 2011 - Housing Commission initiated smoke-free policies for Kottinger Gardens <br /> and Ridge View Commons senior housing developments. <br /> May 2012- Expanded ability of property owner to prohibit smoking in private outdoor <br /> plazas and dining areas added to Ch. 9.24. (Ord. 2038.) <br /> May 2014 - Expanded definition of smoking to include e-cigarettes in Ch. 9.24. (Ord. <br /> 2093) <br /> June 2014 - Parkview senior housing development implemented smoke-free policy. <br /> June 2015- Prohibition on minors possessing e-cigarettes in parks and other public <br /> places added to Ch. 9.32. (Ord. 2120.) <br /> Aug. 2015- Smoking ban for City parks, trails, and adjacent parking lots. (Ord. 2125.) <br /> DISCUSSION <br /> Downtown Smoking Restrictions. Per Council's direction, City staff attended the PDA's <br /> Downtown Vitality Committee meeting on August 26 to engage its members and seek <br /> the PDA's recommendations regarding smoking restrictions in the Downtown. City staff <br /> presented the following options for discussion / consideration: <br /> 1. Special Events / Rentals: The Municipal Code allows renters of City parks & <br /> recreation facilities to establish "reasonable rules of use". So, for example, when <br /> the PDA rents Lions Wayside Park for Friday Concerts In the Park, the PDA (as <br /> the renter) could impose non-smoking rules. <br /> 2. Special Events / Street Closures: Special event permits are processed by the <br /> Police Department for street closures (1St Weds.) or activities needing police <br /> presence (Wine Stroll). Permit applications could be revised to include smoking <br /> restrictions as part of the options for an applicant. <br /> smoking prohibitions in work and public places have been amended and have gotten more strict as state <br /> law and public health concerns about second-hand smoke have changed. <br /> 5 While this report is focused on smoking restrictions, the Council has also taken action to support <br /> smoking reduction, including the June 2001 adoption of Youth Master Plan. That included partnership <br /> goals with the objective to reduce risky behaviors by youth, including smoking. <br /> Page 3 of 8 <br />
