BACKGROUND <br /> On April 28, 2010, the Planning Commission recommended approval of a PUD <br /> application by Dr. William and Lydia Yee to create four buildable single-family custom <br /> home lots. <br /> On June 1, 2010, City Council approved PUD-87-19-03M to allow four buildable single- <br /> family custom home lots on Parcel 1 of Parcel Map 3692 (an approximately 29.82-acre <br /> site). The property is located on the west side of Foothill Road, south of Oak Creek <br /> Drive. <br /> On January 6, 2011, the Staff Review Board, acting within their authority, approved a <br /> minor subdivision application by Dr. William and Lydia Yee to subdivide 4100 Foothill <br /> Road into four lots. <br /> PUD-87-19-03M provides for the construction of the subdivision in three phases. As <br /> allowed by the Subdivision Map Act and the Pleasanton Municipal Code, the developer <br /> elected to initially construct Phases 1 and 2 prior to requesting approval of the parcel <br /> map. Phases 1 and 2 include subdivision improvements serving two (Lots 1 and 2) of <br /> the four proposed lots. The Phase 1 and 2 improvements have been constructed per <br /> the project improvement plans that were reviewed by City staff, approved by the City <br /> Engineer, and prepared in compliance with the approved Vesting Tentative Parcel Map. <br /> Phase 3 of the project, which includes Lots 3 and 4, will be constructed sometime in the <br /> future. <br /> All subdivision improvements serving the two proposed lots (Lots 1 and 2) have been <br /> constructed. The developer has requested City Council acceptance of the public <br /> improvements and has submitted a parcel map to create Lots 1 and 2. The parcel map <br /> is currently under review by staff and will be recorded following the City Engineer's <br /> approval of the map, as authorized by the Municipal Code. At some later time, the <br /> development will undertake Phase 3 of the project. At that time, another parcel map will <br /> be recorded to create Lots 3 and 4. <br /> DISCUSSION <br /> Completed Public Improvements <br /> The driveway, access gate, and utilities including, but not limited to, electric power to <br /> access the gate, landscaping and lighting near the access gate, and the existing <br /> sanitary sewer main along the driveway, shall be private. These improvements will be <br /> maintained by the property owners within the Vesting Tentative Parcel Map area and <br /> the property owners on the west side of the subdivision, who have access rights to the <br /> private driveway and rights to use the private sanitary sewer main, as per a recorded <br /> maintenance agreement. <br /> The onsite improvements include bioswales that were constructed to mitigate storm <br /> water runoff required by the San Francisco Bay Region Municipal Regional Stormwater <br /> NPDES Permit.
