1 0 <br /> ( 1) A copy of the decision shall be conspicuously <br /> posted for a period of ten (10) days in the public <br /> portion of the Department of Community Development <br /> and outside the City Council Chambers . The basis <br /> for the decision that an EIR or Negative Declara- <br /> tion is required shall be provided in the notice <br /> of decision. <br /> (2 ) A copy of the notice of decision and basis <br /> therefor shall be mailed to the applicant . <br /> (3 ) A copy of the notice of decision and basis <br /> therefor shall be distributed to any person who <br /> has requested in writing that he be notified of <br /> the action of the Director . <br /> ( 4) Notice of said decision shall be published in <br /> the official newspaper of the City at least once <br /> during said ten (10) day posting period , the costs <br /> of publication to be paid by the permit applicant <br /> as an additional permit fee. <br /> (b) Appeal from Decision of Director . <br /> Any person may appeal the Director' s decision that a <br /> project requires a negative declaration or an environ- <br /> 1 mental impact report to the City Council . Said appeal <br /> shall be in writing and shall be filed with the City <br /> Clerk not later than the tenth (10th) day following the <br /> date upon which said notice of determination was first <br /> posted or mailed to the applicant or published i'n the <br /> official newspaper of the City , whichever is later. <br /> 1 The filing of an appeal shall stay the Director 's <br /> decision until a final decision is rendered within 30 <br /> days after the filing of the appeal with the City Clerk. <br /> The City Clerk shall cause notice of the time, date and <br /> place of the hearing to be given not less than five (5 ) <br /> days prior thereto to the appellant and the applicant, <br /> if he is not the appellant , and to any other person who <br /> requests such notice in writing . In making its decision <br /> the Council shall be guided by the criteria established <br /> by Section 5 .2 (b) . The City Clerk shall advise the <br /> appellant and the applicant , if he is not the appellant , <br /> in writing of the Council ' s decision . After the 10-day <br /> appeal period, the Community Development Director shall <br /> inform the issuing_authority that the entitlement for <br /> the project is allowed . <br /> Sec . 5 .5 Processing Negative Declaration and Environmental Impact <br />' Report After Appeal Period Lapses . Upon the expiration of <br /> the appeal or completion of the appeal procedure the Director <br /> shall take action either as provided in subsections (a) or <br /> t (b) hereof : <br /> (a) Negative Declaration .
