It should not exceed one (1) page in <br /> length. <br /> (1) The Negative Declaration shall be filed with the <br /> County Clerk of the county, or counties, in which <br /> the project will be located . <br /> ( 2) A copy of a Notice of Determination shall be filed <br /> in the office of the City Clerk and with the <br /> Alameda County Clerk . This Notice of Determination <br /> shall include the decision of the agency to approve <br /> or disapprove the project , the determination of <br /> the agency whether the project will have a signifi- <br /> cant effect on the environment , and a statement <br /> that no EIR has been prepared pursuant to the pro- <br /> visions of CEQA. <br /> (b) EIR. An EIR shall be prepared by the Director consis- <br /> tent with the following procedure : <br /> (1) If the project is to be carried out by a nongovern- <br /> mental person, the Director may require such person <br /> to submit data and information necessary to enable <br /> him to prepare the EIR . This information may be <br /> 1 transmitted in the form of a draft EIR, but the <br /> Director must examine this draft and the informa- <br /> tion contained within it to assure himself of its <br /> accuracy and objectivity and amend the draft if <br /> necessary . The EIR in its final form must reflect <br /> the independent judgment of the Director. <br /> (2) As soon as the draft EIR is completed, but before <br /> copies are sent out for review, an official notice <br /> stating that the draft EIR has been completed shall <br /> be filed with the Secretary of the Resources Agency. <br /> The notice shall include a brief description of the <br /> project , its proposed location , and an address where <br /> copies of the EIR are available . This notice shall <br /> be referred to as a Notice of Completion . A form <br /> for this notice is provided in the Appendices hereto . <br /> The Notice of Completion shall be posted in the same <br /> manner as in § 5 .4(a) . <br /> ( 3) After completing a draft EIR consisting of the <br /> information specified in Sections 7 .2 , 7 .3 and 7 .4 <br /> of these Guidelines , the Director must consult with, <br /> and obtain the comments of, any public agency which <br /> has jurisdiction by law with respect to the project <br /> and may consult with any person who has special ex- <br /> pertise with respect to any environmental impact <br /> involved . The draft EIR shall be filed with the <br /> City Clerk and available for review by the general <br /> public until a Notice of Determination is available . <br /> -14- <br />
