tion shall apply only to easements of record or to ease- <br /> ments established by judgment of a court of competent <br /> jurisdiction and no authority is hereby granted to a <br /> legislative body to determine that the public at large <br /> has acquired easements for access through or use of <br /> property within the proposed subdivision. <br /> <br /> 66474.1. A legislative body shall not deny approval <br /> of a final subdivision map pursuant to Section 66474 <br /> if it has previously approved a tentative map for <br /> the proposed subdivision and if it finds that the <br /> final map is in substantial compliance with the pre- <br /> viously approved tentative map. <br /> <br /> 66474.6. The governing body of any local agency <br /> shall determine whether the discharge of waste from <br /> the proposed subdivision into an existing community <br /> sewer system would result in violation of existing <br /> community requirements prescribed by a California <br /> regional water quality control board pursuant to <br /> Division 7 (commencing with Section 13000) of the <br /> Water Code. In the event that the governing body <br /> finds that the proposed waste discharge would result <br /> in or add to violation of requirements of such board, <br /> it may disapprove the tentative map or maps of the <br /> subdivision. <br /> <br /> NOW THEREFORE, the City Council of the City of Pleasanton <br />does ordain as follows: <br /> <br /> Section 1. Section 2-2.50 (Planning Commission Action) <br /> <br />of Article 4 (Tentative Map) , Chapter 1 (Subdivisions) , Title II <br />(Zoning and Development) of the Ordinance Code of the City of <br />Pleasanton is amended to read as follows: <br /> <br /> Section 2-2.50 (Planning Commission Action) <br /> <br /> (a) The Planning Commission shall assume the re- <br /> sponsibilities relating to tentative maps as <br /> set forth in Government .Code ~Sections 66473.5, <br /> 66474, 66474.1, and 66474.6. The Planning <br /> Commission's actions regarding a tentative <br /> map shall be reported in writing to the sub- <br /> divider. <br /> <br /> (b) The Planning Commission shall act upon a <br /> tentative map within fifty (50) days of its <br /> filing. <br /> <br /> (c) If any interested person is dissatisfied with <br /> any action of the Planning Commission in re- <br /> lationship to the question of consistency with <br /> applicable general or specific plans adopted <br /> by the City or with any of the other findings <br /> or decisions that are required by Government <br /> <br /> <br />
