Code Section 66473.5, 66474, 66474.1 and 66474.6, <br /> or if the subdivider is dissatisfied with any <br /> action of the Planning Commission with respect <br /> to the tentative map, he may, within fifteen <br /> (15) days of such decision, appeal such action <br /> to the Council. The Council shall consider the <br /> appeal within thirty (30) days. This appeal <br /> shall be a public hearing with notice to the <br /> subdivider, the Planning Commission and the in- <br /> terested party, and upon conclusion of the appeal <br /> hearing, the Council shall, within ten (10) days, <br /> render its decision on the appeal. The Council <br /> may sustain, modify, reject or overrule any re- <br /> commendations or rulings of the Planning Com- <br /> mission and may make such findings as are not <br /> inconsistent with the provisions of this chapter <br /> or the Subdivision Map Act of the State. <br /> <br /> Section 2. The immediate preservation of the public safety, <br /> <br /> and welfare requires the adoption of this ordinance as an <br />urgency measure. The fact constituting the need for such action <br />is that Chpater 1536 becomes operative on March 1, 1975. This <br />statute is a comprehensive revision of the Subdivision Map Act <br />and contains numerous procedural changes along with some substan- <br />tive changes. The State Act is necessary to regulate and control <br />the design and improvement of subdivisions throughout the State of <br />California. Development in California is an ever continuing pro- <br />cess and it is necessary for the cities to keep current and im- <br /> <br />plement necessary provisions of the State law. In order that the <br />City's ordinance implementing the State law can take effect and <br />become operative approximately at the same time as the State law, <br /> <br />it is necessary that the effective dates coincide. Therefore, <br />this ordinance is declared to be an ordinance adopted as an ur- <br />gency measure and is to be effective March 1, 1975. <br /> <br /> Section 3. This ordinance shall be published once within <br />fifteen days after its adoption in "THE TIES," a newspaper of <br />general circulation, published in the City of Pleasanton. <br /> <br /> INTRODUCED AND ADOPTED at the regular meeting of the City <br /> <br /> -4- <br /> <br /> <br />
