WHEREAS, pursuant to Government Code Section 66474.7 Council <br />desires to assign responsibilities defined under Sections 66473.5, <br />66474, 66474.1 and 66474.6 to the Planning Commission, said <br />sections reading as follows: <br /> <br /> 66473.5. No local agency shall approve a map unless <br /> the legislative body shall find that the proposed <br /> subdivision, together with the provisions for its <br /> design and improvement, is consistent with the general <br /> plan required by Article 5 (commencing with Section <br /> 65300) of Chapter 3 of Division 1 of this title, or <br /> any specific plan adopted pursuant to Article 8 (com- <br /> mencing with Section 65450) of Chapter 3 of Division <br /> 1 of this title. <br /> <br /> A proposed subdivision shall be consistent with a <br /> general plan or a specific plan only if the local <br /> agency has officially adopted such a plan and the <br /> proposed subdivision or land use is compatible with <br /> the objectives, policies, general land uses and pro- <br /> grams specified in such a plan. <br /> <br /> 66474. A legislative body of a city or county shall <br /> deny approval of a final or tentative subdivision map <br /> if it makes any of the following findings: <br /> <br /> (a) That the proposed map is not consistent with <br /> applicable general and specific plans. <br /> <br /> (b) That the design or improvement of the proposed <br /> subdivision is not consistent with applicable general <br /> and specific plans. <br /> <br /> (c) That the site is not physically suitable for <br /> the type of development. <br /> <br /> (d) That the site is not physically suitable for <br /> the proposed density of development. <br /> <br /> (e) That the design of the subdivision or the <br /> proposed improvements are likely to cause substantial <br /> environmental damage, or substantially and avoidably <br /> injure fish or wildlife or their habitat. <br /> <br /> (f) That the design of the subdivision or the type <br /> of improvements is likely to cause serious public health <br /> problems. <br /> <br /> (g) That the design of the subdivision or the type <br /> of improvements will conflict with easements acquired by <br /> the public at large, for access through or use of, pro- <br /> perty within the proposed subdivision. In this connection, <br /> the governing body may approve a map if it finds that <br /> alternate easements, for access or for use, will be pro- <br /> vided, and that these will be substantially equivalent <br /> to ones previously acquired by the public.
